If you were hurt in an Uber or Lyft crash in Atlanta, you may have a claim against the other driver, the rideshare driver, or the rideshare company, depending on the facts. Georgia law sets the rules for who pays, how fault is split, and how long you have to file. Slam Dunk Attorney is an Atlanta rideshare accident lawyer team based in Duluth, Georgia. Our first consultation is free, confidential, and carries no obligation to continue.

Who a Rideshare Accident Claim Is For

A rideshare accident claim is for anyone hurt in a crash involving an Uber or Lyft vehicle. That includes people inside the cars and people outside them.

  • Rideshare passengers hurt while riding in an Uber or Lyft vehicle.
  • Rideshare drivers injured while driving for Uber or Lyft.
  • Other drivers and passengers hit by a rideshare car.
  • Pedestrians struck by a rideshare vehicle.
  • Families whose loved one died in a rideshare crash.

We represent people across metro Atlanta, including Lawrenceville, Johns Creek, Alpharetta, Marietta, Norcross, Kennesaw, and Dunwoody, and across Georgia.

If an Uber or Lyft crash left you hurt or grieving, you may have a claim, and our team can review the facts with you at no cost. Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Injuries Common in Atlanta Rideshare Crashes

Rideshare crashes cause the same injuries as other car crashes, and some are severe. Side-impact and rear-end collisions often lead to:

  • Neck and back injuries, including whiplash and herniated discs
  • Broken bones and soft-tissue injuries
  • Traumatic brain injuries, which can show symptoms days after a crash
  • Catastrophic injuries, such as spinal cord injury, paralysis, amputation, and severe burns
  • Death, in the most serious crashes

Early medical care protects your health. It also creates a record that links your injuries to the crash. Under O.C.G.A. § 51-12-1.1, medical expenses are limited to the reasonable value of medically necessary care. Careful records of each visit matter. According to the Insurance Institute for Highway Safety, Georgia recorded 1,403 motor-vehicle crash deaths in 2024.

Who May Be Responsible After a Rideshare Crash

Responsibility depends on who caused the crash and what the rideshare driver was doing in the app at the time. Possible responsible parties include:

  • The other driver, if that driver’s negligence caused the crash.
  • The rideshare driver, if that driver caused the crash.
  • Uber or Lyft, through the company’s insurance, when the law and facts allow.
  • A vehicle or parts maker, when a defect may have added to the injury.

App status matters. Under O.C.G.A. § 33-1-24, the company’s services cover the period a driver is logged on to the company’s digital network and available to accept a ride request until the driver is logged off, and the period a driver accepts a ride request until the driver completes the transaction or the ride is complete, whichever is later. Personal auto insurers may exclude coverage while a driver is logged on to the network. Under O.C.G.A. § 40-1-201, a rideshare company is shielded from certain liability only if its own conduct meets the statute’s conditions.

Georgia also divides fault. Under O.C.G.A. § 51-12-33, your damages are reduced by your share of fault. You recover nothing if you are 50 percent or more responsible.

What to Do in the First Days After a Rideshare Accident

Get medical care, document the scene, and speak with a lawyer before you give any recorded statement.

  1. Call 911 and ask for a police report. A report helps document how the crash happened.
  2. See a doctor, even if you feel fine. Some injuries show up later.
  3. Take photos. Capture the vehicles, the scene, road conditions, and visible injuries.
  4. Exchange insurance and contact details. Note the app status and trip details if you know them.
  5. Keep a written log. Record symptoms, appointments, missed work, and expenses.

Your own policy may also help. Under O.C.G.A. § 33-7-11, Georgia auto policies must offer uninsured motorist coverage.

Time limits apply. Under O.C.G.A. § 9-3-33, most injury lawsuits must be brought within two years after the right of action accrues.

How Our Firm Handles a Rideshare Case

Our process starts with a free consultation. It then moves through a fact review, insurance communication, and either a settlement demand or a lawsuit.

  1. Free, confidential consultation. We listen to what happened and answer your questions.
  2. Case review. We look at the crash facts, the police report, your treatment, and your bills.
  3. Identify insurers and parties. We check which policies and parties may apply, including app status.
  4. Insurance communication. We handle contact with insurers, so you do not have to.
  5. Demand and negotiation. We present a demand. If a fair resolution is not reached, we can file a lawsuit.

Timelines vary with the injury, the number of parties, and whether a court case is needed. We explain each step as the case moves forward.

Common Questions About Rideshare Accident Claims

Is the first consultation free?

Yes. The first consultation is free.

Can I sue Uber or Lyft directly?

Possibly. Georgia law limits when a rideshare company is liable for its drivers, so the facts decide the answer.

Will my own fault reduce my claim?

Yes. Under O.C.G.A. § 51-12-33, the judge reduces the damages awarded to the plaintiff in proportion to his or her percentage of fault, and the plaintiff is not entitled to receive any damages if the plaintiff is 50 percent or more responsible for the injury or damages claimed.

Do I need a police report?

A police report helps document how the crash happened. Ask the responding officers how to get a copy.

What if I was a pedestrian hit by a rideshare car?

Under O.C.G.A. § 40-6-93, every driver must use due care to avoid colliding with a pedestrian on a roadway.

How long do I have to file?

O.C.G.A. § 40-6-93 sets no filing deadline; it requires that every driver of a vehicle exercise due care to avoid colliding with any pedestrian upon any roadway. The two-year personal injury filing period comes from a different statute, not this one.
