Hurt in a Car Accident? Start With a Free Consultation
Slam Dunk Attorney helps people injured in car accidents across metro Atlanta and Georgia. Your first consultation is free, confidential and comes with no obligation to continue.
By Peter F.
An auto car accident lawyer investigates the crash, identifies who may be responsible, and presents the injury claim for the person who was hurt. Georgia sets firm filing deadlines and fault rules, so early questions matter. Slam Dunk Attorney is a personal injury firm based in Duluth, Georgia, and offers a free, confidential first consultation.
What an Auto Car Accident Lawyer Does
An auto car accident lawyer handles the injury claim so the injured person does not have to manage every step alone. The work usually includes:
- Reviewing the crash facts and the police report
- Identifying every insurer that may owe coverage
- Collecting medical records, bills, and wage information
- Dealing with adjusters and insurance companies
- Filing a lawsuit if a fair resolution is not reached
This work fits drivers, passengers, pedestrians, motorcyclists, and families of people killed in crashes. We handle matters across metro Atlanta, including Lawrenceville, Johns Creek, Alpharetta, Marietta, Norcross, Kennesaw, and Dunwoody, and across Georgia.
Common causes include distracted driving, speeding, impaired driving, failure to yield at intersections, and unsafe lane changes. Georgia law requires every driver to exercise due care to avoid colliding with any pedestrian on a roadway.
Injuries range from soft tissue injuries and fractures to traumatic brain injury, spinal cord injury, amputation, and severe burns. Some injuries need long-term care, and those needs shape a claim.
Other claims we handle include truck, motorcycle, and rideshare accidents. Georgia requires riders to wear protective headgear that meets state standards.
If a loved one died, Georgia wrongful death law lets a personal representative recover funeral, medical, and other necessary expenses when death results from a crime or from criminal or other negligence.
If a crash left you or someone you love hurt and unsure what comes next, our team is ready to listen and answer your questions at no cost. Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

What Happens After You Request a Free Consultation
After you request a free consultation, the first step is a conversation about your crash and your injuries. You do not need a complete file or every answer.
- Reach out. Call or use our online contact form, and describe the crash in your own words.
- Share the basics. Bring the crash date and location, the police report number, your medical care so far, and insurance details for every vehicle involved.
- Review the path. We explain how Georgia claims usually move: notice to insurers, negotiation, and, when needed, a lawsuit.
- Organize your records. Keep photos, medical bills, pay stubs, repair estimates, and witness names and phone numbers.
The first conversation is one meeting. How long a full claim takes depends on the facts, including how serious the injuries are and how many insurers are involved.
The first consultation is free, confidential, and carries no obligation to continue.
Georgia Deadlines and Fault Rules to Know Early
Most Georgia injury claims must be filed within two years of the injury. O.C.G.A. § 9-3-33 says actions for injuries to the person generally must be brought within two years after the right of action accrues. Loss of consortium claims, which involve a spouse’s loss of companionship, have four years.
Under O.C.G.A. § 51-12-33, a person who is 50 percent or more responsible cannot recover damages. Under Georgia law, a plaintiff’s damages are reduced in proportion to the plaintiff’s percentage of fault, and a plaintiff who is 50 percent or more responsible for the injury or damages claimed is not entitled to receive any damages (O.C.G.A. § 51-12-33). When more than one party is at fault, each pays only its own share.
Your own insurance can matter too. O.C.G.A. § 33-7-11 reads: “(a)(1) No automobile liability policy or motor vehicle liability policy shall be issued or delivered in this state to the owner of such vehicle or shall be issued or delivered by any insurer licensed in this state upon any motor vehicle then principally garaged or principally used in this state unless it contains an endorsement or provisions undertaking to pay the insured damages for bodily injury, loss of consortium or death of an insured, or for injury to or destruction of property of an insured under the named insured’s policy sustained from the owner or operator of an uninsured motor vehicle, within limits exclusive of interests and costs which at the option of the insured shall be.” If the at-fault driver has too little coverage, that provision may be important.
Seat belts can also come up in a claim. Under O.C.G.A. § 40-8-76.1, a court may consider whether a driver or passenger wore a seat belt in a civil case, and that evidence may reduce recovery.
Evidence fades quickly. Save photos, vehicle damage records, and witness contact details early.
Talking to Insurance Adjusters and Protecting Your Claim
An insurance adjuster works for the insurance company. Give adjusters facts, not guesses. The Georgia Office of the Commissioner of Insurance and Safety Fire advises that you promptly notify police and your insurer, gather evidence, and avoid statements that admit responsibility.
Keep these habits in mind:
- You do not have to accept the first offer. Ask questions before you agree to anything.
- Before you give a recorded statement or sign a medical authorization, ask what it covers.
- Stick to what you remember and what your doctors have told you. Avoid guessing about speed or fault.
- Keep records of every medical visit, missed workday, and out-of-pocket expense.
Medical bills matter as well. Georgia limits medical expense damages to the reasonable value of medically necessary care, and health insurance amounts can be part of that evidence.
Some people handle a claim without a lawyer. A consultation can help you judge whether your situation needs more help.

Before you speak with an insurance adjuster
Insurance companies often ask for recorded statements soon after a crash. Before you give one, consider talking with a lawyer. A short consultation can help you understand what to say and what to hold off on while you focus on your health.
Steps that may help after a car accident
Get medical care
Some injuries, including whiplash and head injuries, may not show symptoms right away. Seeing a doctor creates a record of your condition.
Document the scene
If you are able, take photos of vehicles, the road, traffic signs and your injuries. Write down what you remember while it is fresh.
Keep your records
Save police or crash reports, repair estimates, medical bills, prescriptions and notes about missed work.
