Jaraysi · Published October 11, 2026

Premises liability coverage is the part of a property owner’s liability insurance that may respond when someone is hurt because of a condition on the property or an activity taking place there. It is separate from property insurance. Whether it applies depends on the policy wording and the facts of the incident.

This guide explains the key terms in plain language. It is general information, not legal advice. It is written for people hurt on someone else’s property and for family members researching on their behalf.

What Premises Liability Coverage Means

Premises liability coverage is the insurance that may pay on a claim against a property owner or occupier for an injury on that property. The legal claim and the insurance are two different things.

Under Georgia law, an owner or occupier may be liable for injuries caused by a failure to use ordinary care in keeping the premises safe. Georgia’s premises liability statute, O.C.G.A. § 51-3-1, sets out this duty, though how it applies depends on the facts of each case. Whether the duty applies depends on the facts, including the injured person’s status on the property.

The policy controls the coverage side. It sets out what is covered, what is excluded and who counts as an insured. Because a policy is a contract, its exact words matter. Many people search this term because they want to know whether a property owner’s insurance could pay for an injury they or a family member suffered. That question has no one-word answer. For a broader look at premises claims in Georgia, read our premises liability guide.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Is Property Coverage the Same as Liability Coverage?

No. Property coverage and liability coverage address different risks, although one policy can include both.

Property coverage generally addresses damage to buildings, equipment, contents or other property the owner has. Liability coverage generally addresses claims by other people who say they were hurt or had their property damaged.

A storm that damages a roof is a property question. A visitor who slips on an icy walkway and then makes a claim against the owner raises a liability question. For an injury claim, the liability side is the one that matters.

Policies organize these parts differently. Some combine them in one package, and others use separate forms. The scope of each part depends on the policy’s definitions and exclusions. Don’t assume a policy covers a claim just because it covers the building. Read the actual document, and talk with a lawyer about it if you’re unsure.

What Premises Operations Insurance Covers

Premises operations insurance is liability coverage tied to the ongoing activities that happen on a property, such as maintenance, services, deliveries and daily business work.

Policy forms often separate this from completed operations, which deals with work already finished, and from the general condition of the property. Those labels matter. A claim tied to work underway on site may be analyzed differently from one tied to a hazard left in place, depending on the policy’s wording.

Many businesses carry commercial general liability (CGL) policies. Depending on the form, a CGL policy may include premises and operations coverage. Not every form does, so the policy itself is the only reliable source.

Here is a practical example. A contractor hired to repair a stairway may carry its own policy, and the property owner may carry another. Which policy responds depends on who was doing what and what the contracts say.

How Coverage May Respond to a Premises Injury Claim

A claim may be presented to the liability insurer of the party the injured person believes is responsible. The insurer may then look into the facts before deciding how the policy applies.

Several questions can decide whether coverage applies. Who is a named or additional insured? Which policy was in force on the date of the incident? Does the harm fall within the policy’s definition of covered loss? Each answer depends on the documents and the facts.

More than one policy can be involved. A property owner, a tenant, a property manager and a contractor may each carry liability coverage. How those policies work together depends on the contracts and the facts.

An investigation may include requests for records, photos and statements. Whether and how an insurer evaluates or pays a claim depends on the policy and the facts of the case. This guide does not predict how any insurer will act.

Policy Limits and Premium Questions

A policy limit is the most the policy may pay for covered claims under its terms. Some policies apply limits per occurrence, meaning per incident. Others apply an overall total for the policy period. The wording decides which applies.

The declarations page is the summary near the front of many policies. It typically lists the named insured, the policy period and the limits. The full policy then sets out the terms, definitions and exclusions.

Ask the insured party or the insurer for both documents. Reading only the summary can leave out important terms.

A policy limit is not the same as the value of a claim. It is a cap under the policy. Other coverage or other sources may apply, depending on the facts.

Premiums depend on many factors, including the property, the business and the insurer. This guide gives no premium or limit figures, because the right answer depends on the individual policy.

Georgia Premises Duties and Why Coverage Questions Arise

Georgia law sets out an owner’s duty toward people invited onto the property, but coverage is a separate question.

The statute says an owner or occupier who invites or leads others onto the premises for a lawful purpose may be liable for injuries caused by a failure to exercise ordinary care in keeping the premises and approaches safe.

Whether that duty applies depends on the facts. The injured person’s status on the property matters, and so does what the owner knew or should have known. Exceptions exist. A lawyer can review those facts in your case.

Fault can also be divided. Georgia’s apportionment statute, O.C.G.A. § 51-12-33, addresses how an injured person’s share of fault may affect damages and how fault is assigned among parties. How it applies depends on the facts, so it is wise to talk with a lawyer about your own case. It says apportioned damages are each person’s own liability and are not joint. That can matter when more than one policy may be involved. How the statute applies depends on the facts.

A duty question and a coverage question can have different answers. Each needs its own review.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Timelines and What to Ask Before Going Further

No single timeline applies to every premises claim. How long a claim or lawsuit takes depends on the facts, the coverage questions, the parties and the court’s schedule.

Filing deadlines are a separate issue. Georgia sets time limits for filing injury lawsuits, and exceptions can apply. Don’t rely on a general timeframe you read somewhere. Talk with a lawyer about your own deadline soon after the incident.

Questions worth gathering now, framed by the facts of your case:

Who owned, leased or controlled the property on the date of the incident?

Which insurance policies may cover the property owner, a tenant or a contractor?

When and where did the incident happen, and who saw it?

What records of medical care exist? These document treatment only.

Frequently Asked Questions

Is premises liability coverage the same as homeowners insurance? Homeowners policies may include liability coverage. Whether one applies depends on the policy wording and the facts.

Does premises liability coverage apply to every fall on someone’s property? No. Coverage depends on the policy, the parties involved and the facts, so no general answer fits every case.

Is there a standard policy limit? No single limit applies.
