Jaraysi · Published October 10, 2026

What’s the difference between wrongful death and manslaughter? A criminal matter and a civil claim are different kinds of cases that follow different paths. Wrongful death is a civil claim that surviving family members or the estate may bring under Georgia law.

If someone you love has died, you may be hearing both words at once. A police report may use one term, a news story another, and a lawyer a third. This page explains what each term means in Georgia. It is general information, not legal advice. The facts of your situation control the answer.

Two Different Legal Paths After a Death

Manslaughter is a criminal case. Wrongful death is a civil case. The state brings the first, and family members or the estate bring the second.

The two can come from the same incident. A crash, a fall, or an attack may lead to criminal charges, a civil claim, both, or neither. Each runs on its own track, with its own rules and goals.

Criminal cases aim to hold a person accountable under the criminal law. The family does not make that call.

Civil wrongful death claims aim to compensate the people a death left behind. If you are a family member or you represent an estate, a lawyer can walk you through what a civil claim involves.

These are separate cases. Neither one has to happen for the other to exist. How one affects the other depends on the facts and the law.

What Manslaughter Means Under Georgia Criminal Law

Manslaughter is a criminal charge tied to a person’s death. The state, through a prosecutor, brings it. The family does not file it.

They also decide how the case moves forward. Families often learn about these decisions from the court or police, not from the prosecutor directly.

Charges depend on the criminal statute and the facts. The exact wording in the charging papers matters more than any general label. If you’re trying to understand a charge, read the actual document or ask a criminal defense lawyer.

A criminal case may be dismissed, reduced, or resolved without a trial. Any of these outcomes can happen. None of them can be predicted from this page.

A criminal case that ends without charges or a conviction does not automatically close the door on a civil claim. Timing and evidence still matter, so ask a lawyer about your own situation.

Is Manslaughter Always Accidental?

No. Manslaughter is not always accidental. “Accident” is not a legal category on its own.

Others involve conduct that is reckless or negligent, without an intent to kill. Which category applies is a question for the charging documents and the court.

Families often hear that a death “was just an accident.” That phrase describes how it felt to the people involved. It does not tell you which charge applies, if any.

Many people also assume a crash cannot be a crime. Some crashes do lead to criminal charges. The same crash can also support a civil claim, but the two cases still run separately.

Is Involuntary Manslaughter the Same as Negligent Homicide?

Not always. “Negligent homicide” is a label used in some states and in news coverage. It does not always match a specific Georgia charge.

The safest step is to check the exact charge listed in court or police records. A general label from a news article or a friend may not match the paperwork.

Georgia’s civil wrongful death law uses a broader definition of “homicide.” Under O.C.G.A. § 51-4-1, the civil definition covers deaths that result from a crime, from criminal or other negligence, or from defectively manufactured property. That means a civil claim can reach deaths caused by negligence, not only intentional acts.

That civil definition does not decide any criminal charge. It only shows how the civil wrongful death statutes apply.

What Wrongful Death Means in a Georgia Civil Case

A Georgia wrongful death claim is a civil lawsuit for the death of a person caused by another party’s wrongful conduct. The law names who may bring it.

Under O.C.G.A. § 51-4-2, a surviving spouse may bring the claim for the death of a spouse. If there is no surviving spouse, a child or children may bring it for the death of a parent. Under O.C.G.A. § 51-4-5(a), when no one is entitled to bring the action, the administrator or executor may bring it for the next of kin. Claims for a child’s death follow other code provisions that this page does not summarize.

The law measures the recovery as the “full value of the life of the decedent, as shown by the evidence.” Under O.C.G.A. § 51-4-1, that value is not reduced by the necessary or personal expenses the person would have had if they had lived. The actual value depends on the evidence in each case.

Under O.C.G.A. § 51-4-5(b), when a death results from a crime or from criminal or other negligence, the personal representative may recover funeral, medical, and other necessary expenses.

Georgia’s general deadline for personal injury lawsuits is two years under O.C.G.A. § 9-3-33 (Cameron v. JMP Pizza, Inc. (2026)). That rule has exceptions. This page does not state a wrongful death deadline, so talk with a lawyer about timing soon.

Burden of Proof: Why a Criminal Case and a Civil Claim Differ

A criminal matter and a civil claim can involve different ways of presenting a case. The exact standards are a question for your lawyer.

What happens in one kind of case may not decide what happens in the other. What happens in a related criminal matter may be relevant to a civil claim without being the only thing that matters.

The same evidence can appear in both. Records, witness statements, and physical evidence may be used in criminal and civil cases.

Timing matters too. Under O.C.G.A. § 9-3-99, a civil limitation period can be tolled while a criminal prosecution is pending. That tolling ends when the prosecution becomes final or is otherwise terminated. The tolling cannot exceed six years, and the statute has exceptions. A pending criminal case can change the civil deadline, so don’t assume the clock has stopped.

These are general principles. Exceptions and procedural details apply to each case.

Wrongful Death and Medical Malpractice: Are They the Same?

No. Wrongful death is a type of claim that can arise from many causes. Medical malpractice is one of them.

Under O.C.G.A. § 9-3-70, an “action for medical malpractice” covers claims for death or injury from health care services. That includes care from a hospital, nursing home, clinic, or facility, and from its employees acting within their jobs. A wrongful death claim may be built on that kind of negligence when a death results from it.

Georgia has its own rules for professional negligence claims. Under O.C.G.A. § 9-11-9.1, a contemporaneous affidavit filing requirement applies in many professional malpractice actions. The statute also sets limited exceptions tied to deadlines.

Medical claims also have their own time limits. Under O.C.G.A. § 9-3-71, the general medical malpractice deadline is two years from the injury or death, with a five-year outer limit. The statute begins with “except as otherwise provided in this article,” so exceptions apply.

Because these rules are technical, talk with a lawyer about the provider and the timing involved.

Which Is Worse, First or Second Degree Manslaughter?

This page does not rank manslaughter categories. Severity is a question for the criminal court.

Some states label homicide by degree. Georgia’s sources for this page do not set out a degree system, so check the current code and the charging papers rather than relying on a general label.

Sentencing and classification depend on the charge and the facts of the case. A criminal defense lawyer can explain how a specific charge works.

A family’s civil claim is its own matter, separate from any criminal case. The two tracks answer different questions.

Next Steps for Families Facing These Questions

Start by keeping organized records. Gather the police or incident report, medical records, the death certificate, and any criminal case paperwork. Write down important dates, names of witnesses, and where the incident happened.

For the basics of how a wrongful death claim works, read our wrongful death guide. To see what a civil claim generally must show, read about the four proofs of negligence. For local context, see our pages for metro Atlanta and Lawrenceville.

Is involuntary manslaughter and negligent homicide the same thing?

Not always. The labels can overlap, but the exact charge in the court papers controls.

Is wrongful death the same as malpractice?

No. Malpractice is one possible cause of a wrongful death claim.

Is manslaughter always accidental?

No. Some charges involve intent, and others involve reckless or negligent conduct.

Which is worse, 1st or 2nd degree manslaughter?

This page does not rank them. Severity is a question for the criminal court and the charging documents.

Wrongful death and manslaughter answer different questions, and both can feel overwhelming when you’re grieving. If you’re trying to understand whether a civil wrongful death claim may fit your family’s situation, you don’t have to sort it out alone. Contact Slam Dunk Attorney to request a free consultation.

Disclaimer: This page is general information, not legal advice, and it does not promise any result.
