Jaraysi · Published October 10, 2026

What Are the Four Proofs of Negligence?

People often discuss negligence in terms of concepts like duty of care, breach, causation, and damages, and a lawyer can explain how these ideas may apply to your own situation. Some sources call them elements, principles, or components, so you may see different names for the same list.

“Proofs” here means the parts a claim must establish. It isn’t four separate tests you pass one at a time. Each part has to be backed by facts, and the facts of each situation decide how the parts apply.

This framework isn’t written out in a single statute. It’s a general way to organize a negligence claim. Georgia statutes add detail on who owes what to whom, and on how fault and damages are handled. Those rules have exceptions, so treat this page as a starting point. No outcome is promised in any case.

If you're piecing together a crash, a fall, or a loss in your family, you don't have to sort out these elements alone. Whether a duty exists depends on the relationship between the people and the circumstances around them.

Drivers owe care to people on the road. Georgia law says every driver must exercise due care to avoid colliding with a pedestrian on a roadway. Drivers must also take proper precautions when they see a child or someone who appears confused, incapacitated, or intoxicated (O.C.G.A. § 40-6-93).

Property owners owe care to certain visitors. Under O.C.G.A. § 51-3-1, an owner or occupier who invites people onto the property for a lawful purpose must use ordinary care. That care extends to keeping the premises and approaches safe. This applies to stores, apartment complexes, and many other places people visit across metro Atlanta.

Animal owners carry responsibilities too. Under O.C.G.A. § 51-2-7, an owner or keeper of a vicious or dangerous animal may be liable. That can happen when careless management or letting the animal go at liberty causes injury to someone who did not provoke it.

If you have questions about how the different parts of a negligence claim fit together, a lawyer can review the specific facts of your situation with you.

Element Two: Breach of Duty

A breach of duty happens when someone’s conduct falls below the care the situation called for. Whether a breach occurred depends on the facts of that situation.

A driver who speeds or looks at a phone may fall short of due care. A property owner who ignores a known hazard, like a broken stair or an unmarked wet floor, may fail to use ordinary care.

In truck cases, federal rules can matter. Under this section, a driver may drive a total of 11 hours during the period specified in paragraph (a)(2). Whether a particular driver broke these limits depends on that driver’s records. The Insurance Institute for Highway Safety notes that large trucks often weigh 20 to 30 times as much as passenger vehicles (IIHS on large trucks). That difference in size is one reason trucking rules get close attention after a crash.

Negligent security cases follow a different test. Under O.C.G.A. § 51-3-55, an owner or occupier does not have to use extraordinary care against wrongful conduct by a third person. The standard is ordinary care. A breach is shown or not shown based on the facts, including the security measures in place at the time.

Records, photos, and witness accounts are often part of how breach is examined. No single item decides the question.

Element Three: Causation

People often describe causation as the connection between what happened and the harm, and a lawyer can discuss how this may relate to your situation. A person must show the breach led to the injury or loss.

Lawyers and courts often describe causation in two parts. One asks whether the harm actually came from the breach. The other asks whether the harm was a reasonably foreseeable result of it. Terms vary by source, so check the wording used in your own situation.

Causation can be disputed, especially when a person had health problems before the event. It can also be disputed when an injury may have more than one possible cause. Sorting out which injuries came from which event can take time and careful review of medical records. In some cases, medical professionals and accident reconstruction professionals are consulted to help explain how an injury or crash happened.

This section isn’t about which type of evidence matters most. Any type of evidence can help or hurt a claim, depending on what it shows. No type of evidence assures a result, and a single record rarely settles the link on its own.

Element Four: Damages

Damages are the losses a person suffered because of the injury or death. They can include medical bills, lost income, and pain and suffering. Without actual harm, a damages claim generally does not exist.

Georgia law sets a standard for medical expenses. Under O.C.G.A. § 51-12-1.1, medical and healthcare expenses are limited to the reasonable value of medically necessary care, treatment, or services. The trier of fact decides that amount.

Wrongful death cases follow their own statutes. Under O.C.G.A. § 51-4-2(a), a surviving spouse, or a child or children if there is no surviving spouse, may recover for the homicide of a spouse or parent. The statute describes this as “the full value of the life of the decedent, as shown by the evidence.” Under O.C.G.A. § 51-4-5(b), the personal representative may recover funeral, medical, and other necessary expenses when death results from a crime or from criminal or other negligence.

Which damages apply depends on the facts and on Georgia law. A lawyer can explain how these rules fit a specific case.

How the Four Elements Work Together Under Georgia Law

Georgia uses a comparative fault rule. Under O.C.G.A. § 51-12-33, damages are reduced in proportion to the injured person’s percentage of fault. The statute bars recovery when that person is 50 percent or more responsible. Fault can be divided among several people, so the rules can get complicated quickly.

Georgia also has an avoidance rule. Under O.C.G.A. § 51-11-7, a plaintiff who by ordinary care could have avoided the consequences of the defendant’s negligence is not entitled to recover. In other cases, the defendant is not relieved, even if the plaintiff contributed to the injury. How these rules apply depends on the facts.

Showing that someone was at fault does not, by itself, decide how much any recovery will be. Damages, fault percentages, and other rules all play a part.

Deadlines matter as well. Under O.C.G.A. § 9-3-33, actions for injuries to the person generally must be brought within two years after the right of action accrues. The statute has exceptions, including a four-year period for actions involving loss of consortium. Because deadlines have exceptions, talk with a lawyer promptly about your own case.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Common Questions About the Four Elements of Negligence

Short answers to the most common questions appear below.
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
What are the four proofs of negligence?

Negligence claims generally involve several related ideas, including the care one person owes another and the harm that results; the details depend on the facts, so consider discussing your situation with a lawyer.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Are the four elements the same as the four principles of negligence?

Often, yes.
