Jaraysi · Published October 29, 2026

An injury counts as catastrophic when it causes serious, lasting harm that changes a person’s health, independence and ability to work over time. Georgia doesn’t use one checklist to answer this. The answer turns on how severe the injury is, how permanent it appears, and how much future care the person will need.

If you’re asking whether your injury counts as catastrophic in Georgia, you may be scared for yourself or someone you love. Many injuries aren’t fully understood for weeks or months, and that uncertainty is normal. This page walks through the factors people ask about most. It covers injuries from car, truck, motorcycle, pedestrian, rideshare, dog bite, premises, negligent security, short-term rental and nursing home incidents, as well as wrongful death.

What “Catastrophic” Means in an Injury Claim

Catastrophic describes how much an injury harms a person and how long that harm lasts. It does not describe the kind of accident that caused the injury.

In everyday speech, catastrophic means a disaster. In an injury claim, the word describes injuries that are severe, lasting and life-changing. A broken wrist that heals fully is serious, but it usually isn’t catastrophic. A spinal cord injury that leaves a person unable to walk may be.

The same word appears in other areas of law, and each area has its own rules. So the label isn’t one fixed test. A careful review looks at the medical facts, the expected long-term outlook, and how the injury affects daily life and work. Two people with the same diagnosis can have very different limits, so each person’s own records matter.

If your loved one's injury may be permanent, our team can review the records and accident facts with you in a free, confidential initial consultation. A claim has to account for the bills already received and the needs still ahead.

General damages are those the law presumes to flow from a wrongful act, and they can be recovered without proof of any amount. Special damages actually flow from the act and must be proved. Medical costs fall under special damages, and Georgia limits them to the reasonable value of medically necessary care under Georgia’s medical expense rules.

Future losses can also be reduced to present value. The trier of fact, usually a jury, may use a 5 percent discount rate or another rate it finds appropriate, under Georgia’s damages provisions. Put simply, future money may be adjusted to what it is worth today.

Insurers often focus on the injury as it looks right after the accident. The long-term picture, such as future surgery, lost earning ability or a need for a caregiver, is harder to see early. Those losses usually need medical records and treating doctors’ views to show them.

Injuries Commonly Considered Catastrophic

Spinal cord injuries, traumatic brain injuries, amputations and severe burns are the injuries people most often ask about. Each one is judged by its own medical facts, not by its name alone.

Spinal cord injury and paralysis. MedlinePlus explains that paralysis is a loss of muscle function. It can result from catastrophic injuries such as spinal cord injuries. Recovery varies. Research on natural recovery after spinal cord injury looks at how function changes over time, which is why doctors often track progress before describing the long-term outlook.

Traumatic brain injury. The Brain Trauma Foundation notes that traumatic brain injuries can range from mild to catastrophic. They may cause coma, death or serious lasting illness. Changes in memory, thinking, mood or behavior can be as disabling as physical injuries, even when a person looks well.

Amputation. Losing a limb often means prosthetics, long rehabilitation and adjustments over the years. The need for replacement devices and future care can continue long after the wound heals.

Severe burns. Burns that cause deep scarring, skin grafts, repeated surgeries or lasting limits on movement can be catastrophic. The impact often grows as a person works through treatment.

Other serious injuries may also qualify. What matters most is how permanent and disabling the injury is.

Signs an Injury Is Permanent or Long-Term

An injury looks permanent when doctors describe limits that aren’t expected to resolve. Those limits also show up in daily life. Permanence often becomes clear only after recovery levels off, so the signs build over time.

Look for these signs in the medical record:

A treating doctor describes the injury as permanent, or says recovery is expected to be limited.

The person needs lifetime or long-term treatment, therapy, medication or assistive devices.

Restrictions on walking, lifting, driving, working or caring for children continue beyond the early months.

The person needs help with bathing, dressing, cooking or managing money, which they didn’t need before.

Permanent impairment appears in the chart, even while other parts of recovery continue.

A common mistake is waiting to write down limits until things look better. Early notes about what the person can’t do are valuable. They show the injury as it was at the time, not only as it is later.

Evidence That Shows How Serious an Injury Is

The strongest proof of severity is the medical record. It works best when backed by imaging and a treating doctor’s written view of the future. Gather records from every provider, not only the emergency room.

Start with these:

Emergency room and hospital records, including imaging such as X-rays, CT scans and MRIs.

Surgical notes, rehabilitation records and follow-up visits that show progress or lack of progress.

Written opinions from treating doctors about prognosis, restrictions and future care needs.

Physical therapy notes, work restrictions and a daily log of what the person can no longer do.

Accident records, such as police reports, photos, witness names and damage to vehicles or property.

Keep everything in one place and note dates. A log that records the date, the symptom and the limit can show how the injury changed over time.

How the Catastrophic Question Applies Across Different Accidents

The same severity questions apply across the accidents we handle, though each cause raises its own legal issues.

Car and truck crashes. High-impact collisions can cause spinal, brain and limb injuries. Truck crashes involve much heavier vehicles, which can add force to a serious impact.

Motorcycle and pedestrian accidents. Riders and walkers have less protection than people inside a vehicle. Georgia law requires every driver to exercise due care to avoid colliding with any pedestrian upon any roadway. For first steps after a serious crash, see our pedestrian accident guide.

Rideshare accidents. Georgia law sets specific conditions on when a ride share network service can be held liable for a driver’s operation of a car. The severity questions in this guide still apply to the person who was hurt.

Dog bites. An owner or keeper of a vicious or dangerous animal may be liable if careless management or letting the animal go at liberty causes injury. Facial, limb and head injuries from attacks can be permanent. See our dog bite guide.

Premises hazards and negligent security. An owner or occupier may be liable for negligent security when the plaintiff proves the third person’s conduct was reasonably foreseeable and the owner failed to use ordinary care. Serious falls and assaults can cause lasting harm. See our premises liability guide.

Short-term rentals and nursing homes. Falls, burns and untreated complications at rental properties or care facilities can cause permanent harm. Georgia law says a facility resident is entitled to care that is adequate and appropriate and given with reasonable care and skill.

Wrongful death. When a loved one’s catastrophic injuries lead to death, the family may need that injury history to understand what was lost. Georgia law allows a surviving spouse, or children if there is no spouse, to recover the full value of the decedent’s life, as shown by the evidence.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Common Questions About Catastrophic Injuries in Georgia

Here are short answers to the questions people ask most.
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Does my injury count as catastrophic in Georgia?

The answer turns on severity, permanence and future needs, not on a single test. The long-term picture often takes time to come into focus, and Georgia also sets time limits for filing.

Georgia law generally requires a personal injury lawsuit to be filed within two years. That deadline is one reason an early look at the facts is useful.

Keep a daily journal of pain, limits, missed work and tasks the person can no longer do. Ask treating doctors to explain the expected long-term outlook, and write down what they say and when. Waiting to document can make it harder to show what the injury took away.

Talk With Our Team About Your Situation

If you’re caring for an injured spouse, parent or child, or recovering from a serious injury yourself, you may be facing decisions you never planned for.
