Jaraysi · Published October 29, 2026

Why Catastrophic Injury Cases Usually Take Longer

Catastrophic injury cases usually take longer than minor injury claims. The main reason is that no one can judge the full value of the claim until the injured person’s medical picture is clear. Each case turns on its own facts, so this page does not promise a length.

Catastrophic injuries include spinal cord injury and paralysis, traumatic brain injury, amputation, severe burns, and wrongful death. Paralysis is a loss of muscle function. It can result from serious spinal cord injuries, according to MedlinePlus. Brain injuries also range from mild to catastrophic, and the Brain Trauma Foundation notes they can lead to serious, long-term medical care.

A minor sprain may heal in a few weeks. A spinal cord injury may take months of surgery, rehabilitation, and follow-up before doctors can say what function will return. That gap explains most of the delay.

Some stages move quickly. Others wait on doctors. Medical documentation is usually the longest stage, and it sets the pace for the rest of the claim.

If you're facing months of treatment after a serious crash or fall, you don't have to sort out the insurer and the deadlines alone. The early work involves collecting the crash report, photos, witness names, vehicle or property records, and any video that still exists.

The investigation answers four questions. In plain words, they ask who had to act with care, whether they failed to, whether that failure caused the injury, and what the injury cost the victim.

Early evidence matters for practical reasons. Video can be overwritten. Witnesses move or forget details. Scenes change when repairs are made or a property is cleaned up. Notes and photos made soon after an incident keep the facts clear.

Investigation often runs alongside medical treatment. Waiting until care ends before looking into the facts can cost valuable time. The two tracks usually overlap for months.

Stage Two: Medical Treatment, Records, and Future Care

This is usually the longest stage in a catastrophic case. Surgeries, rehabilitation, follow-up medical appointments, and imaging can take months or longer. Recovery is often unclear early on. A peer-reviewed study on natural recovery after spinal cord injury examines how recovery unfolds and which factors affect it. That research helps explain why prognosis often isn’t clear soon after an injury.

Doctors often describe maximum medical improvement (MMI). This is the point where a doctor judges that the condition has stabilized. Claims are often valued after that point because the future becomes clearer. Not every injured person reaches it quickly.

Future needs also must be documented. These can include future surgeries, home changes, assistive equipment, and lost earning capacity. Those needs usually require medical opinions. A claim built on an incomplete picture may understate what the injured person will need over time.

Georgia law limits medical damages to the reasonable value of medically necessary care, as the O.C.G.A. § 51-12-1.1 statute text explains. Keep copies of bills, appointment notes, and records of missed work. These records help show what the injury has cost.

Stage Three: The Demand Letter and Insurance Negotiation

A demand letter is a written summary of who was at fault, what happened, the treatment received, and the amount the injured person asks the insurer to pay. Insurers often respond slowly and ask for more records. Their adjusters may have opened a file early.

The biggest mistake is settling before the full impact is known. A settlement closes the claim. If surgery or care is needed later, that cost may no longer be covered.

Be careful with the insurance company. Avoid recorded statements and detailed talks about your injuries until you have spoken with a lawyer. Don’t sign medical releases or settlement papers without a review first.

Georgia law describes general damages and special damages, as set out in Georgia law on damages. General damages are those the law presumes flow from a wrongful act, and they can be recovered without proof of an exact amount. Special damages actually flow from the act and must be proved, as the O.C.G.A. § 51-12-2 statute text describes. Medical bills are special damages.

Settlement amounts depend on medical costs, future care, lost income, and the strength of the liability evidence. Each claim is different.

Stage Four: Filing a Lawsuit and the Georgia Deadline

Georgia’s general deadline for injury lawsuits is two years (O.C.G.A. § 9-3-33; Kenneth B. Cameron v. Jmp Pizza, Inc (2026)). The O.C.G.A. § 9-3-33 statute text says actions for injuries to the person must be brought within two years after the right of action accrues. Loss of consortium claims have a four-year deadline under the same statute.

Negotiation can continue before that deadline. But a lawsuit must be filed in time to protect the claim. A civil complaint is the formal court document that starts the lawsuit.

Claims against government entities follow different notice rules. A written claim against a municipal corporation must be presented to its governing authority within six months of the event, under O.C.G.A. § 36-33-5. For the State of Georgia, written notice generally must be given within 12 months of the date the loss was discovered or should have been discovered, under O.C.G.A. § 50-21-26.

Wrongful death claims have their own rules. Under O.C.G.A. § 51-4-5, the personal representative may recover funeral, medical, and other necessary expenses when death results from a crime or from criminal or other negligence.

Stage Five: Discovery, Mediation, and Trial

Discovery is the formal exchange of information between the sides. It includes written questions, document requests, depositions (recorded sworn testimony), and medical examinations. In a catastrophic case, discovery often takes many months because records come from many providers.

Mediation is a meeting led by a neutral mediator who helps both sides negotiate. Many cases resolve at this stage. If mediation doesn’t resolve the case, the lawsuit keeps moving forward.

Trial is one possible path, not the usual route for every case. The O.C.G.A. § 51-12-15 statute text sets out that process.

Fault matters too. Under modified comparative fault, an injured person who shares some blame can still recover, but the award is reduced by their share (O.C.G.A. § 51-12-33; Quynn v. Hulsey (2020)). If they are 50 percent or more responsible, they cannot recover damages. Each defendant pays only its own share, not a joint amount, under O.C.G.A. § 51-12-33.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What Can Speed Up or Slow Down a Case

Several factors tend to lengthen a case. These include disputed fault, multiple defendants or insurers, incomplete medical records, and a changing medical condition. Each one adds back-and-forth or waiting time.

Other factors can shorten the process. Clear liability helps. So do complete documentation and an offer that reflects the full picture of care. When the medical story is settled, the valuation work is easier.

Insurers often start building their file as soon as a claim is reported. That early start can make the other side seem ready before the injured person has finished treatment. Timing pressure can push people toward settling too soon.

Which stage applies to you depends on the facts. An early review can show which records matter, which deadlines apply, and what the next step should be.

Talk With Our Team About Your Situation

If you’re living with a serious injury from a crash, fall, dog bite, or negligent care, you may be facing treatment, paperwork, and calls from an insurer all at once.
