Jaraysi · Published October 28, 2026

If a crash involving an Uber or Lyft driver left someone seriously hurt, the coverage answer is rarely one policy. Georgia law sets separate insurance rules for different parts of a ride. The driver’s app status at the moment of the crash is a key fact.

Why Rideshare Insurance Questions Get Complicated After a Serious Crash

More than one insurance policy can apply to a single rideshare crash. That is why the answer is rarely one number.

Picture a family getting a phone call. A loved one was hit while riding in an Uber, or while driving for Lyft. Hospital bills are piling up, work is on hold, and every insurance card seems to point somewhere different.

A minor fender-bender usually ends with a property damage claim and a few medical bills. A serious crash is different. Spinal cord injury and paralysis, traumatic brain injury, amputation, severe burns, and wrongful death all bring long-term costs. Those costs test every policy that might apply.

Three things shape the answer. They are the app status at the time of the crash, the state’s required coverage levels, and the other driver’s insurance, including uninsured or underinsured motorist coverage. For broader background, read our guide to catastrophic injury claims in Georgia.

If a family member was seriously hurt in an Uber or Lyft crash and you're still sorting out which policies apply, our team is glad to talk it through with you. Uber and Lyft are often referred to as transportation network companies, or TNCs.

The first starts when a driver logs on and is available to accept ride requests, and it ends when the driver logs off, except for the time a ride request is accepted, which falls under the second period. The second starts when the driver accepts a ride and ends when the ride is complete, or the transaction ends, whichever is later. Under O.C.G.A. § 33-1-24, these periods carry different minimums.

No more than $50,000 applies to any one person. It must also provide $50,000 for property damage.

After a ride is accepted, the required levels rise.

A driver who is logged on but has not yet matched with a rider is in the first period. Under O.C.G.A. § 33-1-24(a)(5)(B), the second, higher-coverage period begins when a driver accepts a ride request, not when a passenger gets into the car. The app’s status at the exact moment of the crash is the first fact to pin down.

Does Uber or Lyft Insurance Cover Passengers and Others?

Georgia law can shield a rideshare company from some driver-caused injury claims, but only when strict conditions are met. Many people assume the company always pays.

Under O.C.G.A. § 40-1-201, a ride share network service is not liable for injuries caused by a driver’s operation of a personal car. O.C.G.A. § 40-1-201 reads: “(a) No ride share network service shall be liable under any theory of liability, including, but not limited to, vicarious or product liability, for any injury to persons or damage to property from the operation of a personal passenger car by a ride share driver by reason of owning, operating, or maintaining a digital network or internet network to connect passengers to ride share drivers for the purpose of prearranged transportation for hire or for donation, provided that.” Under O.C.G.A. § 40-1-201, that protection applies only when the following conditions are met. The service must not have been negligent or engaged in criminal misconduct. It must comply with the statute’s requirements. It must run a criminal background check, or obtain a private background check certification, for each driver at least once every two years.

The statute also says the company’s digital network counts as a service, not a product. O.C.G.A. § 40-1-201 reads: “(a) No ride share network service shall be liable under any theory of liability, including, but not limited to, vicarious or product liability, for any injury to persons or damage to property from the operation of a personal passenger car by a ride share driver by reason of owning, operating, or maintaining a digital network or internet network to connect passengers to ride share drivers for the purpose of prearranged transportation for hire or for donation, provided that” three conditions are met: (1) the company has not been negligent and has not engaged in criminal misconduct; (2) it complies with the law’s requirements on its obligations to drivers and with any other legal requirements; and (3) it runs a criminal background check, or gets a private background check certification under Code Section 40-5-39, for each driver at least once every two years. That matters for claims that try to treat the app as a defective product.

For any injury to persons or damage to property from a driver’s operation of a personal passenger car, a ride share network service is not liable if there has been no negligence or criminal misconduct by the service, it complies with the requirements of this part, and it conducts or causes to be conducted a criminal background check or obtains a private background check certification for each driver at least once every two years. The trip period carries the highest required levels, so the app status matters most here.

What the Per-Person and Per-Accident Limits Mean in a Rideshare Crash

Bodily injury liability is the part of an auto policy that pays for injuries the insured driver causes to other people. Its limits come in two layers.

A per-person limit caps what any one injured person can receive from that coverage. A per-accident limit caps the total for everyone hurt in the same crash. Under the logged-on levels, one seriously injured person can reach the $50,000 per-person cap.

Serious injuries strain these numbers. A spinal cord injury, traumatic brain injury, amputation, or severe burns can bring surgery, hospital stays, rehabilitation, and long-term care. Those costs can exceed a minimum limit.

Minimums are a floor, not a ceiling. Drivers and rideshare companies can carry higher limits than the state requires. The statute sets what must be in place, and higher coverage may also be available.

How Uninsured and Underinsured Motorist Coverage Fits In

Uninsured and underinsured motorist coverage can pay when the at-fault driver has no insurance or not enough. Uninsured motorist (UM) coverage applies when the other driver has no insurance. Underinsured motorist (UIM) coverage applies when that driver’s limits are too low to cover the harm.

Georgia law requires auto liability policies to include coverage for injuries caused by an uninsured motor vehicle. The insured chooses limits from options the statute lists. See O.C.G.A. § 33-7-11.

The minimum is $300,000 for all people in one accident, with up to $100,000 for one person.

Coverage can stack. An injured person may have a claim under more than one policy, such as the company’s policy, the driver’s policy, or a policy in the injured person’s household. How those layers apply turns on the policy terms and the crash facts.

When Another Driver Caused the Rideshare Crash

When a private driver causes the crash, that driver’s liability insurance is often a first place to look. This is common when a private car hits an Uber or Lyft vehicle. It also happens when a rideshare driver is hit by someone who was not logged into the app.

The rideshare company’s coverage does not have to wait. Under O.C.G.A. § 33-1-24, the company’s coverage is not dependent on a personal insurer first denying a claim. A personal insurer does not have to deny first, either.

Personal policies can exclude coverage during rideshare periods. The statute requires the company to disclose that a driver’s personal policy may exclude damage to the vehicle, medical payments, UM and UIM coverage, and other first-party claims.

Timing records matter. If a personal insurer asks, the company must provide the crash time and the driver’s log-on and log-off times within 15 days. The statute covers the 12 hours before and after the crash.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Why Catastrophic Injuries Raise the Stakes for Coverage

Catastrophic injuries raise the stakes because their costs and losses can last far beyond the first hospital stay.
