A scraped knee and a fractured hip both count. Law uses the word more broadly and more technically, so the everyday meaning is only a starting point.

You will meet the word in different places after a crash. A medical chart describes what the body went through. An insurance letter uses it to describe a claim. A court filing uses it as part of a legal argument. The same word can carry different weight depending on who wrote it and why.

Reading the context matters. A line in a police report may not mean the same thing as a phrase in a settlement offer. Each one deserves a closer look, and a single word rarely tells the whole story.

This page explains general legal concepts. It is not legal advice about any particular case.

The Legal Definition of Injury

In law, an injury is generally a wrong or harm to a person’s legal rights, not only a visible wound. Courts ask whether someone’s conduct caused harm that the law recognizes. That question sits at the center of a personal injury claim.

Georgia law also describes duties people owe one another. Under O.C.G.A. § 51-1-6, when the law requires a person to perform an act for the benefit of another or to refrain from doing an act that may injure another, the injured party may recover for breach of that duty if they suffer damage. Notice the word “damage.” It points to the harm the person actually suffered.

Whether a legal injury occurred depends on the facts of the event. A court looks at what happened, who did what, and what harm followed. Two crashes that look alike on the surface can still raise very different questions.

What Is a Tort Injury?

A tort is a civil wrong that is not a breach of contract. A tort injury is the harm that a civil wrong causes. A car crash is a common example: a driver fails to use proper care and hits another person.

Georgia describes that standard of care in plain terms. Ordinary diligence is the care that ordinarily prudent persons use in similar circumstances. When someone does not use that care, the law calls it ordinary negligence (O.C.G.A. § 51-1-2).

Put simply, a tort injury claim usually asks whether the other person owed a duty, broke it and caused the harm. Tort law also covers property and reputation. The focus of a personal injury claim, though, is the harm to the person’s body, mind and daily life.

Injury, Damages and Bodily Harm: How the Terms Differ

Injury is the wrong or harm itself. Damages are the money a person may seek to make up for that harm. People often mix these words up, but they are not the same thing.

Georgia splits damages into two groups. General damages are those the law presumes to flow from a wrongful act, and they can be recovered without proof of any amount. Special damages actually flow from the act and must be proved (O.C.G.A. § 51-12-2).

Bodily injury means physical harm to the body. Examples include fractures, spinal injuries, brain injuries and burns. Medical bills are a common special damage. Georgia limits those amounts to the reasonable value of medically necessary care (O.C.G.A. § 51-12-1.1).

Insurance letters and medical records use these words differently. An adjuster may use “injury” to describe the value of a claim. A doctor uses it to describe a diagnosis. Reading both carefully helps you know which meaning is in play.

How Injury Works in a Georgia Car Accident Claim

After a crash, an injury is one of the things a person must show, along with fault and cause. Georgia uses a modified comparative fault rule (O.C.G.A. § 51-12-33; Quynn v. Hulsey (2020)). Under O.C.G.A. § 51-12-33, the judge reduces the damages awarded to the plaintiff in proportion to the plaintiff’s percentage of fault, and the plaintiff is not entitled to receive any damages if the plaintiff is 50 percent or more responsible for the injury or damages claimed.

Under O.C.G.A. § 51-12-33, the trier of fact sets the injured person’s percentage of fault. The judge then reduces the award in proportion to that percentage. A person who is 50 percent or more responsible cannot receive damages. Under O.C.G.A. § 51-12-33, if the plaintiff is to some degree responsible for the injury or damages claimed, the judge reduces the damages otherwise awarded in proportion to the plaintiff’s percentage of fault, and a plaintiff who is 50 percent or more responsible may not receive any damages.

The Georgia Supreme Court quoted this rule in QUYNN v. HULSEY.

Medical records matter here. They connect the injury to the crash and show when care began. Symptoms can change over the days after a crash, so keeping every treatment note in order helps the record tell a clear story.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Does Emotional Harm Count, and Is a Claim Worth Pursuing?

Emotional harm is treated differently from physical injury. Pure emotional harm follows its own set of rules.

Whether a claim is worth pursuing depends on the facts. Those include how the crash happened, the injuries involved, the evidence of fault and the insurance available. General information cannot answer that question for a specific case, and it cannot predict a result.

Costs are part of the picture too.
