Jaraysi · Published October 28, 2026

Lost earning capacity is the reduced ability to earn money in the future because of an injury. It looks ahead. It is not the same as pay you already missed. In a Georgia injury claim, this loss can be part of the case when someone else’s fault caused the harm.

What Lost Earning Capacity Means After a Catastrophic Injury

Lost earning capacity is the lower ability to earn that an injury leaves behind. It covers the years of work still ahead, not only the paychecks you missed.

A catastrophic injury is a serious harm that can last for years or for life. Common examples include spinal cord injury with severe paralysis of an arm, a leg, or the trunk, severe brain or closed head injury, amputation of a limb involving effective loss of use, and second or third degree burns over 25 percent of the body as a whole or third degree burns to 5 percent or more of the face or hands. MedlinePlus explains paralysis as a loss of muscle function that can result from spinal cord injuries. The Brain Trauma Foundation notes that brain injuries can range from mild to catastrophic.

The real question is what you could have earned over your working life and what you can still earn. A physical injury may stop you from lifting, standing or driving for your job. A brain injury may affect memory, focus or planning, even when your body looks healthy. Either one can narrow the work you can do.

For an overview of these claims, read our catastrophic injury guide.

If a catastrophic injury has changed the work you can do, our team can talk through your options in a free, confidential initial consultation with no obligation to continue. Lost future earning capacity covers the lower earning power over the working years ahead. Loss of income is a broader term that many people use for both.

Here is how the pieces fit together:

Lost wages to date: Missed pay, overtime and work benefits from the injury date forward.

Future lost earning capacity: The reduced earnings you may face for years, based on the work you can still do.

Loss of income: A general label that can describe both of the above.

Georgia law separates general damages from special damages. O.C.G.A. § 51-12-2 says general damages are presumed from a wrongful act and need no proof of amount. Special damages actually flow from the act, so they must be proved.

Earning losses sit apart from medical bills and pain and suffering. Keeping these categories separate helps you see what each part of a claim is meant to cover.

Can You Recover Lost Earning Capacity in a Georgia Injury Claim?

Yes, in many cases a Georgia injury claim can include lost future earning capacity when another person’s negligence caused the injury. Georgia law treats damages as compensation for injury, measured in money where the harm can be estimated that way. O.C.G.A. § 51-12-4 sets out that principle.

Earning loss can come up after many kinds of incidents. Georgia law requires every driver to exercise due care to avoid colliding with pedestrians on the roadway, per O.C.G.A. § 40-6-93. Premises and negligent security cases often turn on the owner’s duty of ordinary care under O.C.G.A. § 51-3-1, which applies where an owner or occupier, by express or implied invitation, induces or leads others to come upon his premises for any lawful purpose. Short-term rental injuries can raise the same questions.

Rideshare cases add another layer. O.C.G.A. § 40-1-201 limits when a ride share network service is liable for a driver’s operation of a car.

Two rules matter early. Georgia law generally requires injury-to-person actions to be brought within two years after the right of action accrues, under O.C.G.A. § 9-3-33, except for actions for injuries to the person involving loss of consortium, which must be brought within four years after the right of action accrues. Fault also matters. O.C.G.A. § 51-12-33 reduces damages in proportion to your share of fault and bars recovery if you are 50 percent or more responsible. Whether a claim can include earning losses depends on the facts. Waiting can shrink the time you have to act.

Factors Used to Measure Lost Earning Capacity

The main factors are your medical limits, your age and training, your work history, your pay before the injury, your transferable skills and the working years still ahead. No single factor decides the result. They work together.

Medical limits. Treating doctors describe what you can and cannot do now and what may change later.

Age, education and training. These shape the range of work you could move into and how many working years remain.

Work history. Past jobs, their physical and mental demands, and how long you held each one.

Pre-injury earnings. Pay, raises, benefits and how stable your job was before the injury.

Transferable skills. Abilities you can use in other jobs, such as scheduling, customer service or computer work.

Work-life expectancy. The working years still ahead, viewed alongside the injury’s effect on your work.

Medical limits usually carry the most weight. Without a clear medical picture, the rest of the analysis has little to rest on.

How Economists and Vocational Evaluators Are Involved

Vocational evaluators study what work you can still do, and economists turn future losses into a dollar estimate. Together they give the claim structure beyond the paycheck. A vocational evaluator starts with medical records, employment history and the local job market. The evaluator asks which jobs fit your limits and skills, and what those jobs pay.

An economist then works through the earnings difference. Present value matters here. Georgia law lets the trier of fact reduce future economic losses to present value, using a 5 percent discount rate or any other rate it deems appropriate. O.C.G.A. § 51-12-13 states that rule.

These findings get reviewed and tested within the claim. They organize the evidence; they do not replace it. A figure comes only after the medical and work facts are gathered and reviewed.

Catastrophic Work Injuries and the Workers’ Compensation System

When a catastrophic injury happens on the job, workers’ compensation is often the first system involved. It has its own benefit rules, which differ from a personal injury lawsuit against someone else.

Georgia’s workers’ compensation law includes catastrophic injury provisions. O.C.G.A. § 34-9-200.1 says that after a catastrophic injury, the employer must furnish reasonable and necessary rehabilitation services. The statute lists amputation of a limb with effective loss of use, and total or industrial blindness, among catastrophic injuries.

The statute also covers any other injury that prevents the employee from doing prior work and any work available in substantial numbers within the national economy. For up to 130 weeks after the injury, a rebuttable presumption applies that an injury is not catastrophic when it has not been accepted as such and the treating physician has released the employee to restricted work. A rebuttable presumption can be challenged.

A workplace injury caused by a driver or equipment maker may also support a separate claim against that third party. The two systems can run side by side. Which claim fits depends on the injury details and who caused them.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Proof That Supports a Lost Earning Capacity Claim

The core proof comes from three places: medical records, employer records and firsthand testimony. Each one shows a different part of the story.

Medical evidence: Records, imaging, surgical notes and functional capacity testing that document physical limits.

Employer records: Pay stubs, tax returns, job descriptions, performance reviews and written statements about job duties.

Testimony: Accounts from you, family members and coworkers about daily function and past work.

Cognitive limits often drive earning losses, so brain injury documentation matters. Our guide on proving a brain injury after a crash explains that process. Spinal cord injury recovery is also studied closely. A PMC study on natural recovery looks at prognosis and recovery timelines.

Motorcycle crashes with head injuries often involve disputed questions about helmet use and injury severity. Our motorcycle helmet head injury guide covers those issues.

Special Considerations for Children and Young Workers

A catastrophic injury to a child affects a long future of earning years, which makes the calculation more complex. A child usually has little work history, so the analysis looks at the work the child was likely to do.

Vocational evaluators review school plans, training and expected career paths. They also look at how the injury changes those plans. The longer the timeline, the more the assumptions matter.

Timing for a child’s injury can differ from an adult’s claim. Our child catastrophic injury deadline guide covers those timing questions.

Common Questions About Lost Earning Capacity
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
What is lost earning capacity?

Lost earning capacity is the drop in your ability to earn money in the future because of an injury.
