Jaraysi · Published October 27, 2026

Many injury lawyers take a percentage of the settlement, set in a written fee agreement. So, what percent of a settlement does an injury lawyer get? The exact figure is in your agreement, not in a general rule.

If you were hurt, or you are handling a loss in your family, this question may feel urgent. This page gives a plain answer and shows what else comes out of a settlement before you receive the rest.

The Short Answer: Most Injury Lawyers Work on a Percentage of the Recovery

Many personal injury lawyers take a contingency fee. That means the fee is a percentage of whatever the claim recovers. Under that kind of arrangement, the fee is not billed by the hour.

The percentage is set in a written agreement between you and your lawyer. That document is where the exact number lives. Many personal injury lawyers in Georgia and elsewhere work this way.

If you were hurt, cannot work, or are grieving someone you loved, you may be asking this while everything else feels heavy. That is a reasonable thing to ask before you decide anything. Knowing the money side early helps you understand the whole process.

This page covers five things. It explains how the fee is figured, why the rate can change, which case costs come out separately, how medical liens affect what you keep, and what to check in the agreement before you sign.

If a crash, bite, fall, or loss has you weighing your options, our team is glad to talk through your situation with you, with no obligation to continue. The gross recovery is the total paid to resolve the claim, before anything is subtracted.

Here is an example. Suppose an agreement sets the fee at 40 percent of the gross recovery. The fee would be 40 percent of the total, calculated first. This is only an illustration, not a rate to expect.

The next question is the order of deductions. Some agreements take case costs out before the fee is figured. Others take them out after. Both approaches can change the amount you keep, even when the percentage is the same.

That is why a higher percentage is not automatically the biggest cost to you. The full set of deductions decides your final number. Ask your lawyer to run the math step by step, using a sample total. Write down the order and keep it with your papers.

Why the Percentage Can Change Between Early Settlement and Litigation

Many fee agreements set one percentage for a claim settled before a lawsuit. They often set a higher one once a lawsuit is filed.

The reason is work. A case that goes to court usually involves filing papers, exchanging information, and depositions (sworn questions asked under oath). Each step takes effort, and the case can run for many months.

Is 40 percent a lot? That is a fair question to ask. Look at what the agreement says the lawyer will do at each stage, and what triggers the higher rate. A percentage makes more sense when you can see the work and timing tied to it.

Fee terms can also differ by case type. A catastrophic injury, a wrongful death claim, a nursing home abuse matter, and a truck accident case can each have different timelines and costs. Read the agreement for your own matter, not a general example.

Case Costs and Expenses That Come Out Separately

Case costs are separate from the attorney fee. You may still be responsible for them, even when the lawyer works on a contingency basis.

Common case costs include court filing fees, medical record copy fees, accident report and investigation costs, deposition transcripts, and fees for doctors or other professionals who testify. These are costs of pursuing the claim, not your medical bills.

Georgia law treats necessary expenses from an injury as part of the damages estimate. O.C.G.A. § 51-12-7 says necessary expenses from an injury are a legitimate item in that estimate.

The agreement should say whether costs come out before or after the fee. It should also say what happens to costs if the case recovers no money. Ask that question directly.

Some injuries bring larger expense lists. A traumatic brain injury can range from mild to catastrophic and can involve substantial medical care. Spinal cord injury, paralysis, amputation, and severe burn cases often carry similar costs. Our catastrophic injury page covers those claims in more detail.

Medical Liens, Reimbursement Claims, and Total Recovery Versus Net Recovery

Total recovery is the full amount paid to settle. Net recovery is what you keep after the fee, costs, liens, and reimbursement claims are paid.

A medical provider may treat you under a letter of protection. That is a promise to be paid from any settlement. Georgia law makes these arrangements open to review. O.C.G.A. § 51-12-1.1 says the letter, itemized and coded charges, any sale of the provider’s receivables for less than the invoice price, and who made the referral can all be requested in the case.

The same section addresses health insurance.

That is why the headline number and the money you receive can differ. A settlement figure is the total. Ask how liens and reimbursement claims will be paid, and when.

Readers with long-term care needs face ongoing questions. MedlinePlus explains that paralysis is a loss of muscle function and can result from spinal cord injuries. Those cases can carry reimbursement questions that last for years.

What Your Fee Agreement Should Spell Out, and How Fault Can Change It

Your written fee agreement should state the percentage, when it changes, and how costs are handled. Keep a signed copy.

Some firms describe their terms as “no fee unless we win.” Read that phrase alongside the costs section. Those words leave out case costs and expenses, which you may still owe.

Fault can also change the amount you receive. Under O.C.G.A. § 51-12-33, damages are reduced in proportion to your percentage of fault. If you are 50 percent or more responsible, you receive no damages.

Ask your lawyer how fault would be evaluated in your case, and how it would affect the net amount you could keep.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Ready to Talk About Your Situation? You may be reading it for a family member who cannot manage the paperwork right now.

The decision in front of you is whether to speak with a lawyer about the injury or loss.
