It is one fact among many. Its effect depends on how the crash happened and what injuries followed.

If you rode without a helmet and suffered a serious head injury, this question probably worries you most. That worry makes sense. Insurers and defense lawyers may raise helmet use early, often before anyone looks closely at the crash itself.

Think of helmet use as one fact to be weighed, not a final verdict. The rider’s conduct, the other driver’s conduct, road conditions, and the injuries all matter. This page walks through the state helmet rule, how Georgia divides fault, how a brain injury is tied to a crash, and what records and gear to keep.

If you rode without a helmet and still live with head injury symptoms, our team can talk through how your crash facts fit Georgia law. The rule comes from O.C.G.A. § 40-6-315. The same section requires an approved eye-protective device on a motorcycle without a windshield. O.C.G.A. § 40-6-315 reads: “(b) No person shall operate or ride upon a motorcycle if the motorcycle is not equipped with a windshield unless he or she is wearing an eye-protective device of a type approved by the commissioner of public safety.” It does not apply to riders inside an enclosed cab or motorized cart.

The statute sets the rule for riders. Your injury claim asks a different question. It asks who caused the harm and how much each person is responsible for. Those questions overlap, but they are not the same.

In practice, the other side may point to a missing helmet to argue you share the blame. Whether that argument carries weight depends on the facts of your crash, including how you were hit and where your head struck. A claim is judged on the whole crash, not on one item in the file.

How Georgia’s Fault Rules Split Responsibility

Georgia uses modified comparative fault, which is a shared-fault rule (O.C.G.A. § 51-12-33; Quynn v. Hulsey (2020)). Your damages are reduced by your percentage of fault. You recover nothing if you are 50 percent or more responsible. The rule appears in O.C.G.A. § 51-12-33.

Here is how that works in plain terms. Under O.C.G.A. § 51-12-33, if the plaintiff is to some degree responsible for the injury or damages claimed, the judge reduces the damages otherwise awarded to the plaintiff in proportion to the plaintiff’s percentage of fault. A helmet question can be part of that fault split. So can your speed, your lane position, and what the other driver did.

Fault is also apportioned among the person or persons who are liable according to the percentage of fault of each person. Each liable person pays only its own apportioned share, not a joint share. The court must consider the fault of every contributor, including people who were never sued.

A second rule can also apply. Under O.C.G.A. § 51-11-7, if you could have avoided the consequences to yourself caused by the defendant’s negligence by using ordinary care, you cannot recover. If you could not, the defendant is not relieved just because you contributed in some way. This is the avoidance doctrine, and it turns on what you could have done in the moment.

Proving the Head Injury Came From the Crash

A traumatic brain injury (TBI, an injury to the brain from a blow or sudden jolt) can range from mild to catastrophic, according to the Brain Trauma Foundation.

Common motorcycle head injuries include concussion, contusion (a bruise on the brain), skull fracture, and diffuse axonal injury (damage to nerve fibers spread through the brain). Each one leaves different records. Imaging, emergency department notes, and a treating doctor’s chart show which injury you had and when.

The defense may ask whether a different injury would have happened with a helmet. That is a medical question. It is answered with the treating records and, often, medical testimony from a doctor who explains the findings.

Spinal injuries follow the same logic. According to MedlinePlus, paralysis is a loss of muscle function. It can result from a spinal cord injury or a broken neck.

Why Prompt Medical Care and Complete Records Matter

Get checked by a medical provider soon after any blow to the head, even if you feel fine. Mild symptoms are easy to brush off. A medical record made early shows what you reported at the start.

Gaps in treatment, missed symptoms, and changing stories are points the other side often raises. Complete records help answer them. Keep every discharge instruction, appointment card, prescription receipt, and bill.

Start a daily symptom journal. Note headaches, memory lapses, sleep changes, mood shifts, and tasks you can no longer do at work. Write the date beside each entry. A journal shows day-to-day effects that a stack of bills may not show.

Medical costs matter too. Under O.C.G.A. § 51-12-1.1, medical expenses are limited to the reasonable value of medically necessary care. If you have any public or private health insurance, including governmental workers’ compensation benefits, the evidence must include both the amounts charged and the amounts actually needed to satisfy those charges under the insurance contract or program, whether or not the insurance is used to pay them.

Preserve Your Helmet, Gear, and Crash Evidence

Keep your helmet exactly as it came off after the crash. Do not repair, clean, repaint, or throw it away. Impact marks, cracks, and scrapes can show how your head struck the road or a vehicle. That physical evidence can matter to both the crash and medical questions.

Keep the rest of your gear too. Save your jacket, gloves, boots, and any clothing you wore. If you can, leave the motorcycle in its post-crash condition, and tell your lawyer where it is stored.

Collect what you can at the scene or soon after. Write down the police report number, witness names and phone numbers, and details of the scene. Take photos of the vehicles and road. Save any dash camera or phone video.

Be careful online. Do not post about the crash, your injuries, or your helmet on social media. The other side can use posts and messages in the claim.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Common Questions About Helmets and Head Injury Claims

Here are short answers to the questions riders ask most about helmets and head injury claims in Georgia.
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Can I still sue if I was not wearing a helmet?

Yes, a missing helmet does not automatically end a claim in Georgia.
