Jaraysi · Published October 27, 2026

A Medicare or Medicaid lien is a government program’s claim to be repaid from a settlement for medical care it already paid. If you were badly hurt and a public program covered your bills, this claim can affect what is left from your recovery. This guide explains how each type of lien works in Georgia and what to ask early.

What Is a Medicare or Medicaid Lien After a Catastrophic Injury?

A Medicare or Medicaid lien is a program’s claim to get back money it paid for your care from your injury recovery. It is a claim against the settlement, so it matters most when money is ready to be paid out.

Catastrophic injuries often mean very large medical bills. MedlinePlus explains that paralysis is a loss of muscle function and can result from catastrophic injuries such as spinal cord injuries. The Brain Trauma Foundation notes that traumatic brain injuries can range from mild to catastrophic and can lead to substantial medical care.

Amputation and severe burns can also mean surgery, long hospital stays, rehabilitation, and equipment over many months. When a person is covered by Medicare or Medicaid, those programs may pay for much of that care. The bills then become part of the repayment question at settlement.

If Medicare or Medicaid paid your catastrophic injury bills and a settlement offer is now in front of you, our team can help you sort out what must be repaid. Medicare’s interest is part of the settlement math, not a separate bill you pay later from your budget.

Some people are enrolled in a Medicare Advantage plan instead of traditional Medicare. Whether that plan has its own repayment rights is a question to verify early. Ask the plan directly and get the answer in writing.

Raising Medicare’s interest early helps you avoid surprises when funds are ready to be disbursed. Waiting until the final day can leave the numbers unclear when they matter most.

How Georgia Medicaid Liens Work

Medicaid covers both adults and children, so the claim can arise in a crash, a fall, or another injury case involving a child or an adult.

That difference can change how the claim is documented and resolved.

Ask three questions early. Which agency is involved? What has it paid so far? Has it sent a notice of its claim? Written answers make the rest of the case easier to plan.

Hospital Liens Under Georgia Law

It is separate from a government program’s claim, even when both involve the same treatment.

Whether a particular lien meets those steps is a question to check early, using the lien paperwork and the hospital’s records, not at the closing table.

Hospital liens also differ from health insurance claims. When health insurance pays, the insurer may seek repayment from a settlement under the terms of its contract. How the hospital’s lien and the insurer’s claim fit together turns on those terms.

An unresolved lien can delay or complicate how settlement funds are paid out. That is one reason to raise every lien question before the settlement is finalized.

How Insurance Payments Affect the Medical Expense Amount

Payments from health insurance or government programs can change the medical-expense figure a claim presents in Georgia. The rules are set out in Georgia’s damages statute.

Medical special damages are limited to the reasonable value of medically necessary care, and the jury decides that amount. O.C.G.A. § 51-12-1.1 says that when the plaintiff has public or private health insurance, the evidence includes both the amounts charged and the amounts actually necessary to satisfy those charges. That applies whether or not the insurance has been used.

The same statute limits the common law collateral source rule (a rule that normally keeps outside payments away from the jury) to the extent needed to admit that evidence. A judge may also instruct the jury about collateral source payments.

Future medical costs and lost wages are economic damages. Under O.C.G.A. § 51-12-13, the trier of fact may reduce those future amounts to present value. It may use a 5 percent discount rate or another rate it deems appropriate.

Can Liens Be Negotiated or Reduced?

Some lien holders will discuss the amount. Whether a reduction is possible depends on the facts, the lien type, and the holder’s own rules.

Several steps help the discussion. First, request itemized bills so you can see each charge and its code. Georgia law makes itemized, coded charges relevant in claims for treatment provided under a letter of protection.

Second, verify the amount actually paid. Under O.C.G.A. § 51-12-1.1, either side may challenge the reasonableness of medical expenses, whether incurred or projected. Either side may also challenge the medical necessity of treatment.

Third, ask the lien holder in writing whether it will accept a reduced amount. Never assume the answer before you ask.

Negotiation generally happens before the settlement is finalized and funds are disbursed. A settlement agreement should also state how each lien will be paid and released.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Deadlines and Timing Questions

Georgia generally requires an injury lawsuit to be filed within two years. O.C.G.A. § 9-3-33 provides that, except as otherwise provided in this article, actions for injuries to the person must be brought within two years after the right of action accrues. Loss of consortium claims fall under a four-year period in the same statute.

Lien claims don’t simply go away. They usually have to be paid, reduced, or resolved as part of the settlement. Leaving them open can delay the final numbers.

Catastrophic cases often involve ongoing treatment and future care. Early preparation helps you document those needs before the claim is valued. Cases involving minors raise separate timing questions, which our child catastrophic injury deadline page covers.

Questions to Raise Early in a Catastrophic Injury Claim

The most useful early questions cover who paid, how much, and what notices have already gone out. Bring these to your first conversation with a lawyer.

Which government programs or insurers paid for treatment, and how much has each paid so far?

Was a hospital lien filed, and in which county?

Has Medicare or Medicaid issued a conditional payment or recovery notice?

Does any Medicare Advantage plan claim its own repayment right?

How will future medical needs and lost earning capacity be valued?

For motorcycle crashes, ask how head injury and helmet use will be documented. Head injuries often shape the long-term medical picture, which affects future care costs.

Frequently asked questions
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
What is a Medicare Medicaid lien?

It is a government program’s claim to be repaid from a settlement or judgment for medical care it already paid.
