Jaraysi · Published October 26, 2026

Georgia Slip and Fall Contingency Fee: What You Need to Know

If you were hurt in a slip and fall, money may be one of your first worries. A Georgia slip and fall contingency fee is a common way lawyers get paid in these cases. This guide explains how it works in plain language, which costs can still apply, and what to ask before you sign anything. It is general information, not legal advice.

How Do Georgia Personal Injury Lawyers Charge for Slip and Fall Cases, and What Percentage Is Typical for a Contingency Fee?

In many Georgia slip and fall cases, the lawyer is paid a percentage of any money recovered. This is called a contingency fee. The written agreement sets that percentage, so the exact figure is the one in your contract.

No single percentage fits every case. Articles online often quote a typical number, but a number from a blog is not your agreement. Read the figure in writing before you decide anything.

A contingency fee is usually taken from the recovery. You generally aren’t billed by the hour. You still need to know which costs come out of your money, and when.

Each client signs their own agreement, so terms can differ from one matter to the next. Keep a signed copy. Check how the percentage changes if the claim goes to a lawsuit. Ask questions until every term is clear to you.

What a Contingency Fee Means in a Georgia Slip and Fall Case

A contingency fee means the lawyer’s payment depends on a recovery, such as a settlement or a court judgment. If the claim brings in nothing, the lawyer generally isn’t paid a fee under that arrangement. Costs are a separate question, covered in the next section.

Slip and fall claims start with the property owner’s duty. Georgia law says an owner or occupier who invites people onto the land must use ordinary care to keep the premises and approaches safe (O.C.G.A. § 51-3-1). Proving that duty takes work. It often means gathering photos, incident reports, and records about the hazard. A Georgia DOAS slip and fall guide points to spills, obstructions, and walkway upkeep as areas to address.

The time and work vary from case to case. Your agreement may set different terms before a lawsuit is filed than after one begins. Read each stage before you sign.

Fault matters too. Georgia uses modified comparative fault. A person 50 percent or more at fault recovers nothing, according to a Georgia Supreme Court opinion quoting O.C.G.A. § 51-12-33. A smaller recovery means a smaller amount, because the judge shall reduce the amount of damages otherwise awarded to the plaintiff in proportion to his or her percentage of fault.

Case Costs and Expenses a Client May Still Owe

A contingency fee does not mean you owe nothing in every case. You may still be responsible for court costs and case expenses. These can include filing fees, charges for records, and fees for outside reviews or medical records, depending on the case.

Agreements handle expenses in different ways. Some have the lawyer advance costs and repay them from a recovery. Others place them on the client. Ask which model your agreement uses.

Find out directly whether you’d owe expenses if the claim brings in nothing. That answer can change your financial picture a great deal.

Order matters at settlement. Suppose a settlement is reached. If expenses come out before the percentage is applied, the fee is figured on a smaller amount. If they come out after, the fee is figured on the full recovery. Your net amount can differ, so ask which order your agreement uses and get it in writing.

Questions to Ask About the Fee Agreement Before You Sign

Bring these questions to any fee conversation, and write down the answers.

What percentage applies before a lawsuit is filed, and what applies if the case goes to court?

Which case expenses will I owe, and are they owed if nothing is recovered?

Are expenses subtracted before or after the percentage is applied?

Can I get a signed copy of the agreement to keep?

Timing matters too. Georgia’s general deadline to file a personal injury lawsuit is two years, as quoted in a Georgia Court of Appeals opinion on O.C.G.A. § 9-3-33. The start date for that clock can turn on the specific facts of your injury.

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Do I still owe court costs with a Georgia slip and fall contingency fee?

You may.
