Jaraysi · Published October 25, 2026

How long does it take to get paid after a wrongful death settlement? The honest answer is that it depends on the facts of each case. Money usually follows the signed agreement, but several steps must finish first. This guide explains those steps in plain language.

What Determines How Long a Wrongful Death Settlement Takes to Pay Out

The time to payment depends on how many steps remain after the agreement, and who must act on each one. Two questions often get mixed together. The first is how long the lawsuit takes to settle. The second is how long payment takes after the settlement is agreed. This page covers the second question.

For the earlier stages, read our wrongful death guide and our guide to how long a wrongful death lawsuit takes.

The order of steps after agreement is usually similar from case to case. What changes is how long each step takes. Those steps include paperwork, signatures, lien resolution, and any court review. Families in Atlanta and nearby cities face the same Georgia rules.

If your family is waiting on a wrongful death settlement and unsure what comes next, our team can talk through each step with you. The settlement agreement and release set out what is paid and what the claim gives up. A release is the document that ends the claim against the party responsible for the death.

The person authorized to act for the estate signs first. Other family members may need to sign too. Gathering those signatures can take time, especially when people live in different places.

Next, the insurer or defendant issues payment. Payment often goes to a trust account or a payee named in the agreement. It usually does not go straight to family members.

Each step can add time. Paperwork must be complete. Signatures must be collected. The insurer must process the payment. Funds generally do not reach the family until these steps finish. That is why the total wait often runs longer than people expect.

Who Must Sign and Who Receives the Money Under Georgia Law

Georgia law sets out who may bring a wrongful death claim and how any recovery is shared. A surviving spouse may bring the claim for the death of a spouse. If there is no surviving spouse, a child or children may bring it.

Under O.C.G.A. § 51-4-2, the claim seeks the full value of the life of the decedent, as shown by the evidence.

When there is a surviving spouse and children, the spouse receives no less than one-third of the recovery. The recovery is divided equally among the surviving spouse and the children per capita, with the spouse’s share never less than one-third, and the descendants of children take per stirpes.

The same section says a surviving spouse may release the claim without a court order or the children’s consent. The spouse must then hold the money under the sharing rules and stays accountable for it. The section also says no recovery is subject to the decedent’s debts or the estate’s debts.

See O.C.G.A. § 51-4-5.

How Court Approval and Minor Beneficiaries Can Affect the Timeline

When a minor child is a beneficiary and there is no surviving spouse, the natural guardian, guardian, or next friend must obtain court approval of the settlement before payment, as provided in O.C.G.A. § 29-3-3. The guardian, natural guardian, or next friend must qualify as a conservator if needed to receive the payment. A conservator is a person the court appoints to manage money for someone who cannot manage it alone.

The guardian must also obtain court approval of the settlement under O.C.G.A. § 29-3-3. Under the same wrongful death section, if there is no surviving spouse and an action for wrongful death is brought by a minor child or minor children, the natural guardian, guardian, or next friend must obtain court approval of the settlement of the minor child as provided in O.C.G.A. § 29-3-3.

After approval, the conservator holds and uses the money for the child’s benefit. The conservator must account for it. Court calendars and filing requirements can add weeks or more. Timing also varies by county.

Liens, Reimbursement Claims, Fees, and Case Costs

A lien is a claim by someone else to be repaid from the settlement. Medical providers, health plans, or government programs may have one.

Questions about how Medicare and liability insurance may coordinate on accident-related medical bills can be complicated, and they are worth discussing with a lawyer during a free consultation. That can affect how a recovery is handled. The CMS Medicare Secondary Payer overview explains the basic rules.

Medicare conditional payment recovery in liability settlements runs through the CMS Medicare Secondary Payer Recovery Portal. These claims take time to verify and resolve. That work often happens while the settlement is pending.

The fee agreement and the settlement statement show how attorney’s fees, case costs, and liens come out before the family gets the net amount. The client may still be responsible for case costs and expenses under the fee agreement. The settlement statement lists those amounts. The family should review that statement closely.

Lump Sum or Structured Settlement: How the Payment Method Changes Timing

A lump sum is paid in one payment. A structured settlement pays over a set schedule of installments.

The payment schedule is set when the agreement is made. So the first payment in a structured settlement may come later than a lump sum would. Each payment follows the terms that were agreed.

Read the payment method in the settlement documents before signing. Ask your lawyer to explain it in plain words. Make sure you understand when each payment is due.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Why Payment Timelines Vary From Case to Case

Several factors shape the timeline. These include the number of beneficiaries, any minor beneficiaries, lien resolution, court approval, signature collection, and the payment method.

A file where every beneficiary and lienholder is identified usually moves more predictably. Open questions about who is owed what tend to slow things down.

Deadlines also differ by defendant. For claims against the City of Atlanta, the City of Atlanta claim filing information describes a written notice requirement within six months of the event. Georgia’s general personal-injury filing period is two years under O.C.G.A. § 9-3-33, as quoted in a Georgia appellate filing. Early review helps families understand which deadlines may apply.

Each case moves on its own schedule. No number of days or weeks applies to every family, but under O.C.G.A. § 9-3-33, actions for injuries to the person shall be brought within two years after the right of action accrues, except as otherwise provided.

Talk Through Your Family’s Situation With Our Team

If you are waiting on a settlement after a loss, you may be grieving while handling someone else’s affairs.
