Whether it’s worth the time, stress, and cost turns on your injury and the evidence behind it.

People who ask “Is it worth suing for pain and suffering?” are usually asking two questions. First, does the harm qualify? Second, does the likely recovery justify the process of a lawsuit? This guide covers both, using Georgia’s statutes.

No one can promise how a particular claim will end. Read this as general information about how the system works. If you’re hurt right now, the deadline and fault sections below are worth reading early.

What Qualifies as Pain and Suffering Under Georgia Law

Pain and suffering is the non-economic part of an injury claim. It covers the physical pain and emotional harm an injury causes, not just bills or paychecks. Georgia’s statute lists noneconomic harms, including physical or emotional pain, anxiety, distress, mental anguish, disfigurement, and loss of enjoyment of life (O.C.G.A. § 9-10-184).

Georgia’s statute defines economic damages as pecuniary damages recoverable in tort for bodily injury or wrongful death, and noneconomic damages as all other damages recoverable in tort for those injuries or deaths (O.C.G.A. § 9-10-184). If an injury is small or the mitigating circumstances are strong, only nominal damages are given (O.C.G.A. § 51-12-4).

Some injuries are entirely to a person’s peace, happiness, or feelings. For those, the statute says no fixed measure applies, except the judgment of impartial jurors (O.C.G.A. § 51-12-6).

The harm must be real, documented, and connected to the accident or the conduct at issue. A feeling that no record supports is hard to prove. For harm in a care facility, start with our nursing home abuse claims overview.

Types of Pain and Suffering Damages

Pain and suffering covers several kinds of non-economic harm. Each one describes a different way an injury changes daily life.

Physical pain: ongoing or recurring pain, including pain during therapy and everyday tasks like dressing, driving, or sleeping.

Mental anguish and emotional distress: fear, anxiety, sleep trouble, or depression tied to the incident.

Loss of enjoyment of life: no longer able to work at a hobby, care for family, travel, or do activities you valued before.

Disfigurement and permanent change: scarring, lost function, or a condition that continues after treatment ends.

Loss of consortium: the effect of an injury on a spouse’s relationship. Georgia’s statute lists loss of consortium among noneconomic damages.

Serious injuries, such as spinal cord injury, traumatic brain injury, amputation, or severe burns, often bring lasting changes. Those changes can shape every category above.

How Pain and Suffering Differs From Medical Bills and Lost Wages

Pain and suffering is non-economic. Medical bills and lost wages are economic damages, which are easier to measure. Georgia defines economic damages to include medical expenses, rehabilitation and therapy costs, lost wages, lost earning capacity, and funeral expenses (O.C.G.A. § 9-10-184).

Bills and pay records prove economic losses. Pain and suffering has no receipt. It is shown through medical records describing symptoms, testimony, and a clear account of how the injury changed your daily life.

Medical expenses have their own rule. Georgia limits them to the reasonable value of medically necessary care, treatment, or services (O.C.G.A. § 51-12-1.1). In practice, a claim with large bills but little documented daily impact can look very different from one where that impact is well recorded.

How Pain and Suffering Is Valued: Why There Is No Set Payout

There is no fixed formula or standard payout for pain and suffering in Georgia. The statute says the measure of noneconomic damages is the enlightened conscience of an impartial jury (O.C.G.A. § 9-10-184). O.C.G.A. § 9-10-184 reads: “(c)(1) In the trial of any action to recover damages for bodily injury or wrongful death, counsel for any party shall be allowed to argue the worth or monetary value of noneconomic damages only after the close of evidence and at the time of such party’s first opportunity to argue the issue of damages, provided that such argument shall be rationally related to the evidence of noneconomic damages and shall not make reference to objects or values having no rational connection to the facts proved by the evidence.”

A number usually comes from one of two paths. One is negotiation with the insurer. The other is a verdict from a jury. Either way, the facts drive the result. Clear fault, the severity and permanence of the injury, the length and consistency of treatment, and how well the record supports the story all matter.

Online calculators and “multiplier” tools promise a figure. They can’t weigh your medical records, your witnesses, or the fault in your case. The same statute also limits how lawyers may argue a dollar value for noneconomic damages in front of a jury. Any argument must tie back to the evidence.

How Hard Is It to Prove Pain and Suffering?

Pain and suffering is proven with evidence, so a thin record makes it harder to prove. Prompt treatment, follow-up visits, detailed provider notes, and imaging help show both the injury and its cause.

Other useful evidence includes:

a daily journal of pain levels and activities you can no longer do

statements from family, friends, or coworkers about changes they have seen

records of missed work, events, or activities

Gaps make proof harder. Delayed treatment, missed appointments, unexplained prior conditions, and inconsistent descriptions of symptoms are common points of dispute.

Nursing home residents often can’t describe their own pain clearly. Federal guidance defines abuse to include conduct that causes physical harm, pain, or mental anguish (CMS State Operations Manual Appendix PP). That makes charts, staff records, and family observations central. Our guide on what evidence proves elder abuse covers this in more detail.

Pain and Suffering in Nursing Home Abuse and Wrongful Death Cases

Pain and suffering can be part of a nursing home claim. A Georgia wrongful death claim for the homicide of a spouse or parent may be brought by the surviving spouse or, if there is no surviving spouse, a child or children, and is measured by the full value of the life of the decedent, as shown by the evidence.

Georgia law says each nursing home resident must receive adequate care, with reasonable care and skill and respect for dignity and privacy (O.C.G.A. § 31-8-108). Any person aggrieved because a long-term care facility violated or failed to provide a resident’s rights under this law has a cause of action against that facility for damages (O.C.G.A. § 31-8-126). Who else may be responsible is covered in our guide to liable parties in Georgia nursing home cases. Concerns about care can also go to the Georgia Department of Community Health complaint page, which accepts complaints online, by telephone, or by fax.

For wrongful death, Georgia’s statute lets a surviving spouse recover the full value of the decedent’s life, as shown by the evidence. If there is no spouse, a child or children may recover (O.C.G.A. § 51-4-2). When death results from a crime or from criminal or other negligence, the personal representative may recover funeral, medical, and other necessary expenses (O.C.G.A. § 51-4-5).

Costs, Deadlines, and Fault: Practical Questions That Affect Whether to Sue

Your own share of fault can reduce a recovery. Georgia reduces an award in proportion to the plaintiff’s fault, and a plaintiff who is 50 percent or more responsible cannot recover damages (O.C.G.A. § 51-12-33).

Time limits matter too. Actions for injuries to the person must be brought within two years after the right of action accrues. Loss of consortium actions have four years (O.C.G.A. § 9-3-33). Waiting can close options.

A lawsuit can carry court filing fees, records fees, witness fees, and other case expenses. You may still be responsible for court costs and case expenses, however your lawyer’s fee is arranged. Weigh the non-economic harm against the time, stress, and cost. Some claims settle without trial. Others go to court.

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Is it worth suing for pain and suffering if I was partly at fault?

Partial fault reduces an award in proportion to your share.
