Jaraysi · Published October 24, 2026

How much compensation on average if a pedestrian is hit by a car? There is no single average that fits every case in Georgia. Your claim’s value depends on your injuries, your bills, your lost pay, and the fault facts of the crash. Online averages often mix cases from other states and other injuries, so they rarely match one person’s situation. This page explains what goes into a pedestrian claim. It does not offer a number, because a fair figure can only come from the facts of your own case.

Why There Is No Single Average for a Pedestrian Hit by a Car

Averages rarely describe one person’s claim, because every claim is built from its own losses. Many published averages blend pedestrian cases from different states, injury types, and insurance setups. A minor fracture and a spinal cord injury can land in the same average. That tells you little about what happens in your case.

In Georgia, a claim is built from the specific harm the crash caused. That includes the medical care you need, the income you lost, and how the injury changes your daily life. Two people struck at the same crosswalk can have very different injuries and very different claims.

Online calculators and settlement tables often hide these details behind one figure. Ask what a figure actually includes before you rely on it. If you are reading this while someone you love is still in the hospital, you may not have time for long research. This page sets one clear expectation. It explains the parts of a claim so you know what to gather and what to ask.

If you were hit while walking, or a loved one was, and an adjuster is calling, you can talk through the facts with our team at no cost. General damages are those the law presumes to flow from a wrongful act (a tort), and they can be recovered without proof of an exact amount. Special damages actually flow from the act, and they must be proved. O.C.G.A. § 51-12-2

Medical costs are usually the most visible category. They can include emergency care, hospital stays, surgery, imaging, medication, physical therapy, and future treatment. Under O.C.G.A. § 51-12-1.1(b), special damages for medical and healthcare expenses are limited to the reasonable value of medically necessary care, treatment, or services, and the trier of fact determines that amount.

Lost wages count as well, including lost earning ability if the injury affects future work. The jury may reduce future economic losses to present value. It can use a 5 percent rate or another rate it thinks fits.

Pain, fear of crossing streets, and lost enjoyment of life are real losses. They have no fixed price tag, so their value is judged case by case. Bills, pay stubs, and treatment notes support each category. A simple daily log of pain and missed activities can also show how the injury affects you.

Factors That Affect the Value of a Claim

The type and length of the injury, along with how well the proof ties it to the crash, shape a claim’s value the most. Injuries differ widely. A fracture that heals in weeks is not the same as a head injury, internal bleeding, or nerve damage that lingers. Doctors often describe injuries as temporary or lasting, and that difference matters.

Surgery, extended hospital stays, and ongoing treatment add to the medical record and to the cost of care. Injuries that limit work, driving, child care, or daily tasks also change the claim over time. Lasting limits usually need more documentation than short recoveries.

Evidence matters just as much. The Georgia police crash report is the official record used to collect and share crash data, and the Georgia Department of Transportation crash reporting page explains how to obtain these reports. Witness names, scene photos, vehicle positions, and medical records that link the injuries to the crash also count. Gaps in that proof give the other side room to argue.

Insurance coverage is the last major factor. Available policies set practical limits on what can be paid, and the next section covers that in more detail. Two crashes that look alike can still produce very different claims.

How Insurance Coverage Shapes a Pedestrian Claim

The driver’s liability insurance is often the first source of payment in a pedestrian claim. Its limits can cap what that policy pays, so the policy details matter. Your own policy may matter too.

Georgia requires auto policies issued in the state on any motor vehicle principally garaged or principally used in Georgia to include uninsured motorist coverage unless an insured named in the policy rejects it in writing. This coverage pays the insured for bodily injury caused by an uninsured driver. The insured’s combined recovery from that coverage and the liability coverage on the uninsured vehicle cannot exceed the total of all economic and noneconomic losses. O.C.G.A. § 33-7-11 A hit-and-run crash can raise questions about which coverage applies. Reading your own policy closely helps you see what it covers.

Health insurance, medical payments coverage, or other benefits may pay bills while the claim is open. Georgia law lets the court look at both the amount billed and the amount insurance actually requires to be paid. O.C.G.A. § 51-12-1.1

An adjuster’s early call or first offer is a starting point. It is not a final measure of what your claim is worth.

Right of Way and Fault Under Georgia Law

In Georgia, drivers must stop for pedestrians within a crosswalk, marked or unmarked, when the pedestrian is in certain positions. Pedestrians still have duties, and a jury can assign them a share of fault.

A driver must stop and stay stopped when a pedestrian is in a crosswalk on the driver’s half of the road, or is approaching within one lane of it, unless the conditions stated in subsection (b) of Code Section 40-6-92 apply. Drivers must take extra precautions around a child or anyone who is obviously confused, incapacitated, or intoxicated. O.C.G.A. § 40-6-93

Pedestrians have duties too. A pedestrian may not suddenly leave a curb or safe place and walk into a vehicle’s path when it is too close for the driver to yield. O.C.G.A. § 40-6-91 Under subsection (a) of this section, a vehicle driver must stop and remain stopped to allow a pedestrian to cross the roadway within a crosswalk when the pedestrian is upon the half of the roadway the vehicle is traveling on, or is approaching and within one lane of that half.

A person who is 50 percent or more at fault cannot recover damages. O.C.G.A. § 51-12-33

The other side may argue you were partly at fault, for example for crossing outside a crosswalk or stepping out quickly. Those arguments make the facts of the crash matter a great deal.

Evaluating an Early Settlement Offer

An early offer often arrives before anyone knows how the injury will turn out. Treatment may still be underway. Before you respond, ask a few questions.

Is treatment finished, or does a doctor expect more care? Are future medical needs and work limits known? Are all bills, receipts, and missed pay documented? If any answer is “not yet,” the offer may not reflect the full claim.

Timing matters too. Actions for injuries to the person must generally be brought within two years after the right of action accrues. O.C.G.A. § 9-3-33 Other deadlines may apply in some situations.

Before you sign any paperwork, ask what it covers and whether it closes the claim. Keep medical records, receipts, pay stubs, and a simple log of pain, limits, and missed activities. Those records make the claim easier to value.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

When Injuries Are Serious or a Pedestrian Dies

Serious injuries and wrongful death claims take longer to value, because the long-term picture develops slowly. Pedestrian crashes can cause serious harm, including head injuries, and people outside vehicles are especially vulnerable in collisions. Governors Highway Safety Association

Spinal cord injuries, traumatic brain injuries, amputations, and severe burns often involve lifetime care. The full picture can take time to become clear. Future medical costs, home changes, equipment, and long-term care needs are recorded through medical records and treatment plans.

When a pedestrian dies, the family’s focus shifts quickly. Georgia law sets out who may bring a wrongful death claim, and it sets the rules and deadlines for those claims. Families often keep records of final bills, funeral costs, lost income, and the household support the person provided. Those records show what the loss means in practical terms.

Talking Through Your Situation With Slam Dunk Attorney

If an adjuster has called you, or a loved one is still recovering, the next step can feel unclear and urgent.
