Jaraysi · Published October 24, 2026

A good slip and fall settlement offer fairly pays for your injuries, your medical bills, your lost income, and the care you still need. There is no single correct number. In Georgia, an offer is measured against the facts: how you were hurt, how strong the proof of fault is, and how much blame a court might assign to you. This guide explains those pieces so you can judge an offer before you answer it.

A slip and fall settlement offer is a payment that ends your claim

A settlement offer is a proposed payment to resolve your injury claim. To accept it, you usually sign a release. A release gives up your right to seek more money for that injury, so the claim typically ends for good. Read every page before you sign.

Most slip and fall claims target the property owner or occupier. Georgia law says an owner or occupier of land who invites people onto the land must use ordinary care to keep the premises and approaches safe (O.C.G.A. § 51-3-1). Ordinary care means reasonable care. If a failure to use it caused your fall, you may have a claim.

An offer should pay for losses you have already had and losses you will likely have later. Georgia separates general damages, which the law presumes flow from a wrongful act, from special damages, which must be proved (O.C.G.A. § 51-12-2). Medical bills and lost wages are examples of losses that are often documented with records. No formula sets the final amount. It is negotiated.

If an adjuster's first offer has you wondering whether it covers your bills and the care still ahead, our team can talk it through with you in a free, confidential first consultation. The injury comes first. A sprain, a fracture, a head injury and a surgery each raise different questions. Some diagnoses take weeks or months to become clear, so an early offer may rest on incomplete facts.

Treatment comes next. In injury or death civil actions, Georgia limits special damages for medical and healthcare expenses to the reasonable value of medically necessary care (O.C.G.A. § 51-12-1.1). Gaps in care and unexplained treatment give the other side room to challenge the bills.

Proof of fault matters too. Useful evidence includes photos of the hazard, incident reports, surveillance video, maintenance records, prior complaints about the same spot, and witness names.

Your own share of blame may be the biggest issue. If you are 50 percent or more responsible, you cannot receive damages (O.C.G.A. § 51-12-33). Georgia also bars recovery if you, by using ordinary care, could have avoided the consequences of the other side’s negligence, but in other cases the other side is not let off just because you contributed in some way (O.C.G.A. § 51-11-7). Insurers often say the hazard was obvious. Whether that argument holds depends on the facts.

How insurers arrive at a first offer

An insurer’s first offer is usually made before treatment ends. That means it often reflects only part of the medical picture. Adjusters may ask for a recorded statement, request broad medical records, or point to a pre-existing condition. Each request can shift how the claim is valued.

Insurers also review the money spent on care. If the plaintiff has any form of public or private health insurance, Georgia law looks at both the amounts charged and the amounts actually necessary to satisfy those charges under the insurance contract or applicable governmental workers’ compensation program, whether or not the insurance has been, is, or will be used to pay them (O.C.G.A. § 51-12-1.1). A bill total is not automatically the value of a claim.

If an offer seems too low, the Georgia Office of the Commissioner of Insurance and Safety Fire publishes insurance claim tips on documentation and negotiating an inadequate offer. Start a simple, dated log of pain, missed work, and daily limits now. It supports every number you discuss later.

What a settlement pays for after fees, costs and liens

The gross settlement is not the amount you keep. The net figure depends on attorney fees, case costs and expenses, and any reimbursement claims tied to your medical care.

Medicare is one example. Some injury claims involve Medicare, and questions about how it may affect a settlement are worth discussing with a lawyer. The CMS Medicare Secondary Payer Recovery Portal handles that process, so ask about any Medicare payments before you accept.

Our first consultation is free, confidential, and carries no obligation to continue. If a claim moves forward, the client may still be responsible for court costs and case expenses, as explained at that point.

How to evaluate an offer before you respond

Check each offer against a short list before you answer it. Has treatment ended, or is the prognosis known? Are all bills and lost wage records included? Does the offer cover future care? Does the release cover only this claim, or does it add confidentiality or indemnity terms?

A counteroffer is a normal part of negotiation. Accepting an offer typically ends the claim, so take the time you need before you sign.

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Should I accept the first offer?

Usually not until treatment and the full cost of your injury are clear. Accepting ends the claim.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
How long do I have to file a claim?

For most injuries to the person in Georgia, the deadline is two years from the date the right of action accrues (O.C.G.A. § 9-3-33). Whether a settlement offer affects any filing deadline is a question to review with a lawyer.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Does Georgia use comparative fault?

Yes. Georgia reduces your damages by your share of fault, and a plaintiff who is 50 percent or more at fault recovers nothing (O.C.G.A. § 51-12-33).
</details>

Common mistakes that can weaken a slip and fall claim

Most weak claims come from a few avoidable errors. Giving a recorded statement before you understand the claim is one. Another is posting about the fall, your activities, or your injuries on social media.

Delayed or skipped medical care is a third mistake. It gives an insurer an opening to argue the injury is less serious. Signing a release before you know the full extent of your injuries is a fourth.

Finally, keep evidence. Save the shoes and clothing you wore, photos of the spot, and the names of anyone who saw the fall.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

If an offer is in front of you now, you don’t have to decide alone

If you are recovering from a fall, managing bills, or helping a family member, an offer can feel urgent.
