Jaraysi · Published October 24, 2026

If you’re asking how much does a lawyer charge to sue, the honest answer has two parts. The lawyer is paid one way. The lawsuit itself costs money another way. Most people only hear about the first part.

This guide explains both parts in plain language. You’ll learn what to ask before you decide what to do next.

If you’re reading this for someone else, you may be doing it under stress. An injured person may still be in treatment, out of work, or facing bills. Clear answers make the next step easier.

What You Are Really Paying For When You Sue

A lawsuit has two separate cost categories: attorney compensation and case costs. Attorney compensation is what the lawyer earns for doing the work. Case costs are the bills that come from running the case itself.

Case costs are paid to the court, to records offices, to court reporters and to witnesses. They are not the lawyer’s pay. Even so, they often come up in the same conversation.

Case costs are out-of-pocket expenses. Filing fees, medical record copies and deposition transcripts are common examples. A deposition is sworn testimony taken outside the courtroom. Each bill is real, and together they can add up over the life of a case.

Keeping these two categories apart helps you sort out what you hear. A low hourly rate doesn’t tell you the full cost. Neither does a low filing fee.

How Injury Lawyers in Georgia Are Commonly Paid

Many injury lawyers in Georgia are paid a contingency fee. This is a percentage of any money recovered for the client. If nothing is recovered, the lawyer generally doesn’t earn that percentage.

The percentage and how it’s calculated should appear in the written agreement. Read the agreement closely before you sign. Ask what the percentage applies to, and whether it is figured before or after costs are paid.

Here’s the part people often miss. A contingency fee does not mean the client owes nothing. The client may still be responsible for court costs and case expenses. The written agreement should say how those are handled, including what happens if there is no recovery.

Our team offers a free, confidential first consultation with no obligation to continue. You can ask about fee terms there before you decide anything.

Court Filing Fees and Other Case Expenses

Court filing fees are charged by the court where a case is filed. Fees can vary by court, so the filing location matters. Ask which court would hear your matter and what fee it charges.

Other common case expenses include:

Medical and billing records. Providers often charge to copy them.

Deposition transcripts. The court reporter bills for the written record.

Professional witnesses. Treating physicians or engineers may charge to testify about injuries or what caused a hazard.

Service of process. This is the cost of formally delivering court papers to the other side.

Under many agreements, the firm advances these costs and is repaid from any recovery. Your agreement should say who pays up front and how repayment works.

A common mistake is assuming costs stay small because the filing fee is small. The bigger costs often come later, from records and testimony.

When Lawyers Charge by the Hour Instead

Hourly billing is more common for matters that are not injury claims, such as some business or contract disputes. Under this model, the client pays for the time the lawyer spends on the matter at a set rate.

The rate, any retainer, and the billing schedule should be in the engagement letter. A retainer is an upfront deposit that the lawyer draws against as work is done. Some lawyers bill monthly. Others bill at set points in the matter.

Many injury claims are handled on contingency terms instead. Hourly billing can make the total harder to predict. Ask for the rate and how often you’ll receive a bill.

Ask during your consultation which billing method applies to your matter. Get the answer in writing.

What Changes the Total Cost of a Lawsuit

The total cost of a lawsuit changes with three main factors. These are how complex the facts are, how many parties and insurers are involved, and whether the case settles or goes to trial. Each one adds work and expense.

Fault matters too. Under O.C.G.A. § 51-12-33, a judge reduces damages in proportion to the plaintiff’s share of fault. A plaintiff who is 50 percent or more responsible recovers no damages. That makes fault a central question from the start.

Slip and fall cases show this clearly. Under O.C.G.A. § 51-3-1, an owner or occupier who, by express or implied invitation, leads people onto its property for any lawful purpose must use ordinary care to keep the premises and approaches safe. Proving that duty often turns on evidence.

That evidence can include whether the owner knew about the hazard, surveillance footage, and incident reports. Each one takes time to request and review. Footage can be lost if it isn’t requested in time, so early requests can change how much work a case needs. You can read more on our slip and fall page.

Why Timing Affects the Cost of Waiting

Georgia’s general deadline for injury claims is two years. O.C.G.A. § 9-3-33 says, except as otherwise provided in this article, actions for injuries to the person must be brought within two years after the right of action accrues. The same section gives four years for actions involving loss of consortium.

Waiting can make a claim more costly to build. Surveillance footage may be overwritten. Witnesses move or forget details. Records take time to collect. A later start can mean more work to rebuild the proof.

Don’t assume the general two-year period fits your situation. Get a review of your timeline early, so you know which deadline may apply.

Talk Through Your Fee and Cost Questions

If you’re deciding whether a claim is worth pursuing, you don’t have to hire anyone yet. Many people start by asking questions. Some are trying to understand a fall on a store floor, an icy walkway, or an unsafe rental property.

Common questions include how the lawyer is paid, what the case will cost, and how long they have to act. These are fair questions to ask before you decide anything.

Common Questions
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
How much does a lawyer charge to sue in Georgia?

Lawyers may charge a contingency fee, a percentage of any recovery, or bill by the hour.
