Jaraysi · Published October 24, 2026

Negligence is proven by showing four things. The other side owed you a duty of care, broke that duty, caused your harm, and you suffered damages. This page explains each element in plain words, along with the evidence and state rules that shape a claim.

If you are asking how is negligence proven, you may be trying to make sense of a crash, a fall, a dog bite, or a loss you did not expect. You may be asking on behalf of someone you love. That is a hard place to be. The steps below are meant to make the process easier to follow.

What Negligence Means in a Georgia Injury Claim

Negligence means failing to use the care a careful person would use in the same situation. That failure must cause harm. Georgia law puts it this way: O.C.G.A. § 51-1-2 says ordinary diligence is the care that ordinarily prudent people use under similar circumstances. The absence of that care is ordinary negligence.

A negligence claim is a civil case. Its goal is compensation for the injury. It is not a criminal charge.

The same four-part framework applies across the case types this firm handles. That includes car and truck crashes, motorcycle and pedestrian accidents, rideshare trips with Uber or Lyft, and dog bites. It also covers slip and fall and premises injuries, negligent security, nursing home abuse, short-term rental injuries, catastrophic injuries, and wrongful death. The facts change from case to case. The four questions do not.

If someone you love was hurt, the details may still be unclear. That is common. Writing down what you know now helps you and anyone you speak with later.

If someone you love was hurt or died and you're not sure who may be responsible, our team is glad to talk through the facts with you. The first question is whether the other side owed you that obligation.

Duties often come from the relationship and the circumstances. Georgia law also writes some duties down. Under O.C.G.A. § 40-6-93, every driver must exercise due care to avoid colliding with any pedestrian upon any roadway.

Property duties work the same way. Under O.C.G.A. § 51-3-1, an owner or occupier who invites people onto the property for a lawful purpose must use ordinary care in keeping the premises and approaches safe. This duty sits at the center of premises and slip and fall cases.

Other duties follow the relationship. A nursing facility owes its residents proper care and protection. The Georgia Department of Community Health’s long-term care resources describe how these facilities are overseen in Georgia.

Wrongful death cases raise the same question. The fatal event must trace back to someone who owed the person who died a duty. Our wrongful death guide explains how those duties apply when a loss is fatal.

Element Two: Breach of Duty

A breach happens when someone fails to meet the standard of care that fits the situation. You show a breach by comparing what the other side did with what a prudent person or business would have done.

Examples are common. A driver who speeds or texts may breach the duty to drive carefully. A property owner who leaves a known hazard unrepaired may breach the duty to keep the premises safe. So may a building with broken lighting or locks, or a facility that runs short on staff. Each case turns on its own facts.

Written rules can show what careful conduct looks like. The driver duty in § 40-6-93 requires proper precautions when a driver sees a child or an obviously confused, incapacitated, or intoxicated person. Company safety policies and inspection schedules can play a similar role.

Negligent security cases use a specific standard. Under O.C.G.A. § 51-3-55, an owner or occupier is not required to use extraordinary care to protect people from a third person’s wrongful conduct. The question is whether the owner used ordinary care. The trier of fact considers the security measures in place at the time. It also considers whether more measures were needed, whether they were practical, and whether they would have prevented the injury.

That last point matters. A bad event on a property does not prove breach by itself.

Element Three: Causation

It links what the other side did wrong to the harm you suffered.

Causation has two parts. If a distracted driver caused a rear-end crash, the question is whether the crash would have happened without that distraction.

Causation is usually shown through medical records and a clear timeline. Emergency room notes, imaging, treatment records, and follow-up visits show what was injured and when. The timeline connects the event to the harm.

Causation is often where disputes focus. The other side may argue that an older injury, a pre-existing condition, or a later event caused the problem. Those arguments are weighed against the evidence, including medical history, prior treatment records, and when symptoms first appeared.

The same Georgia rules apply whether a crash or fall happened in Atlanta, Lawrenceville, or Johns Creek. Local facts, such as the location and which records exist, still shape the proof.

Element Four: Damages

Damages are the losses the injured person suffered because of the harm. They must be shown with proof.

General damages are those the law presumes to flow from a wrongful act. Under O.C.G.A. § 51-12-2, they may be recovered without proof of any amount. Special damages actually flow from the act and must be proved. Medical bills and lost wages are common examples, and they need records.

Medical expenses have their own rule. Under O.C.G.A. § 51-12-1.1, special damages for medical and healthcare expenses are limited to the reasonable value of medically necessary care, treatment, or services. The trier of fact decides that amount. Bills, provider notes, and treatment records are central.

Catastrophic injuries show why documentation takes time. Spinal cord injury, traumatic brain injury, amputation, and severe burns can have effects that appear over months or years. Care and rehabilitation often must be recorded across that whole period.

Wrongful death follows a different path. Under O.C.G.A. § 51-4-5, when no one else is entitled to sue, the administrator or executor may bring the action for the next of kin. The amount of recovery is the full value of the life of the decedent. When death of a human being results from a crime or from criminal or other negligence, the personal representative of the deceased person is entitled to recover for the funeral, medical, and other necessary expenses resulting from the injury and death of the deceased person.

Under O.C.G.A. § 51-12-5.1, punitive damages may be awarded only in such tort actions in which it is proven by clear and convincing evidence that the defendant’s actions showed willful misconduct, malice, fraud, wantonness, oppression, or that entire want of care which would raise the presumption of conscious indifference to consequences.

Evidence That Is Commonly Used to Prove Each Element

So how is negligence proven in practice? Through evidence tied to each element, gathered as early as possible. Common types include:

Crash and incident reports. The Georgia Department of Public Safety describes help for victims and families on the status of an investigation. The Georgia State Patrol investigates crashes involving major injuries.

Photos and video. This includes surveillance footage and dashcam footage.

Witness statements. Statements gathered soon after the event are often the most reliable, because memories are fresh.

Medical records. Imaging, treatment notes, and the timeline of care show the injury and its course.

Premises and facility records. For premises, nursing home, and short-term rental cases, these include maintenance logs, inspection records, prior complaints, and safety policies.

Trip, driver, and vehicle records. For rideshare and truck cases, these include app and trip data, driver records, and maintenance logs.

Qualified professional witnesses. These help explain technical subjects to a judge or jury.

Preserving evidence matters. Photos taken soon after, written notes, and early requests to keep video can prevent key proof from disappearing. The firm cannot say in advance what the evidence will show.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Georgia Rules That Shape How Negligence Is Proven

Georgia can reduce a claim, or bar it, when the injured person shares fault. Under O.C.G.A. § 51-12-33, the judge reduces damages in proportion to the injured person’s percentage of fault. If that person is 50 percent or more responsible, the plaintiff does not recover damages under that section.

Fault can be spread among several people. Damages apportioned to each liable person are that person’s own liability, not joint liability. The trier of fact considers the fault of everyone who contributed, whether or not they were named in the suit.

Georgia also sets filing deadlines. Under O.C.G.A. § 9-3-33, actions for injuries to the person must be brought within two years after the right of action accrues. Loss of consortium actions have four years. Other deadlines can apply, so timing should be checked early.

Seat belt use also matters. Under O.C.G.A. § 40-8-76.1, the failure of an occupant of a motor vehicle to wear a seat safety belt may be considered in any civil action as evidence admissible on the issues of negligence, comparative negligence, causation, assumption of risk, or apportionment of fault, subject to a court’s determination of admissibility under Code Section 24-4-403 or any other statutory or common law rule of evidence, and may be used to diminish recovery for damages arising out of the ownership, maintenance, occupancy, or operation of a motor vehicle.

Talking With Peter F.
