Jaraysi · Published October 23, 2026

How Long Does a Pedestrian Accident Settlement Take?

There is no single standard length. A pedestrian accident settlement can take months, and sometimes longer, because the pace depends on the facts of each claim. Four stages usually set the timing: medical recovery, the investigation into fault, insurer negotiations, and any lawsuit that follows.

Simple claims and serious claims follow very different timelines. A claim with clear fault and minor injuries often moves faster. A claim involving a head injury, several at-fault parties, or disputed fault usually takes longer at every stage. Many people expect a set number of months, then find the process moves in phases.

This page explains how each stage works. It does not predict how long any particular claim will take. For the wider picture, see our pedestrian accidents guide.

If bills and unanswered questions are piling up after a pedestrian injury, our team can talk through your situation with you. A pedestrian struck by a vehicle can suffer fractures, head injuries, or soft-tissue damage that take months to heal. Settlement talks often wait until treatment is far enough along that the injuries and costs are clear.

Georgia law limits how medical costs are proven. Under O.C.G.A. § 51-12-1.1, medical expenses are limited to the reasonable value of medically necessary care, treatment, or services. The trier of fact decides that amount. Every bill, visit note, and prescription therefore matters.

Keep a file of every appointment, bill, and missed day of work as it happens. Records gathered in the moment are easier to use than records rebuilt months later. Some treatment is paid through a letter of protection, where a provider treats you in exchange for a promise of payment from any judgment or settlement. Under the same statute, that letter and the itemized charges are relevant and discoverable in a claim.

Liability Investigation and Evidence Gathering

Fault must be settled before most claims can resolve. Police reports, driver and witness statements, photos, and video help show what happened. Some records, such as vehicle data or traffic camera footage, must be requested, and those requests take time.

Georgia law sets what drivers owe pedestrians. Under O.C.G.A. § 40-6-93, every driver shall exercise due care to avoid colliding with any pedestrian upon any roadway. Under O.C.G.A. § 40-6-91, a driver must stop for a pedestrian in a crosswalk when the pedestrian is on the driver’s half of the roadway or approaching within one lane of it.

Disputed fault is where timelines stretch. A driver may say the pedestrian left a curb and walked into the path of the car. Georgia law addresses that too. Under the same section, no pedestrian shall suddenly leave a curb or other place of safety and walk or run into a vehicle’s path when it is so close that it is impractical for the driver to yield. Each side may argue its version, and that means more records and more review.

Preserve evidence early. Photos, witness names, and the locations of nearby cameras can be lost over time. Gathering them while medical care continues keeps the case moving.

Insurance Negotiations and Why They Take Time

Negotiation is often the longest stretch of a claim that settles. After a claim is presented, the insurer reviews the file, asks for records, and responds. Offers and counteroffers usually move back and forth over several rounds before any agreement is reached. Some talks wrap up quickly. Others stall for months.

Policy limits shape these talks. When the at-fault driver’s coverage falls short of the losses, other coverage may matter. The Insurance Information Institute explains how uninsured and underinsured motorist coverage fits into accident claims.

Factors That Lengthen or Shorten the Timeline

The biggest timing factors are injury severity, the number of parties, and disputed fault. Catastrophic injuries such as spinal cord injury, traumatic brain injury, or amputation often need a long medical period before the full effect is known. Claims with that much uncertainty usually take longer to value.

Several at-fault parties add layers. Under O.C.G.A. § 51-12-33(b), the trier of fact apportions damages among the persons who are liable according to the percentage of fault of each person, and those damages are not a joint liability among them. Each party’s insurer may need to be part of the discussion, which adds steps.

Rideshare claims bring extra coverage questions. Under O.C.G.A. § 33-1-24, a transportation network company must provide, during the specified period, a minimum of $1 million for death, personal injury, and property damage per occurrence. The same section lets a personal vehicle insurer exclude coverage while a driver is logged on to the company’s network. Sorting out which policy applies takes time.

Filing a lawsuit changes the pace. Once a case enters court, it moves through formal steps that usually take longer than a negotiated settlement.

Georgia Deadlines That Shape the Timing

Georgia generally gives two years from the injury to bring a lawsuit for injuries to the person. Under O.C.G.A. § 9-3-33, except as otherwise provided in this article, those actions must be brought within two years after the right of action accrues, except for actions for injuries to the person involving loss of consortium, which must be brought within four years after the right of action accrues. A claim that does not settle may need to be filed before that date. Waiting for every medical answer can shrink the time left.

Fault also affects value. Under O.C.G.A. § 51-12-33(a), the judge reduces the damages awarded to the plaintiff in proportion to the plaintiff’s percentage of fault. Under subsection (g) of the same statute, a plaintiff who is 50 percent or more responsible for the injury or damages claimed is not entitled to receive any damages.

In a lawsuit, future losses may be adjusted too. Under O.C.G.A. § 51-12-13, the trier of fact may reduce future medical expenses, lost wages, and other economic damages to present value, using a 5 percent discount rate or another rate it deems appropriate.
