Jaraysi · Published October 23, 2026

If you’re asking what is the most common cause of pedestrian accidents, the short answer is driver behavior. Distraction, failure to yield, speeding, and impaired driving come up most often when pedestrian crashes are studied. This guide explains each cause in plain language, shows how Georgia law treats them, and explains what they mean for a person on foot.

The Short Answer: What Crash Data Points To Most Often

Driver behavior is one of the factors that can contribute to pedestrian crashes. Within that group, failure to yield and driver distraction come up again and again.

“Cause” here means a factor that investigators or analysts record. This general information does not establish how any single crash happened.

Causes often overlap. A driver who glances at a phone and then rolls through a crosswalk has created two problems at once. Speed can add a third. The Georgia Department of Driver Services notes that the risk of serious or fatal pedestrian injury increases at higher vehicle speeds.

If a driver hit someone you love and you're trying to understand how it happened, you don't have to sort it out alone. Common examples include using a phone, texting, eating, adjusting a touchscreen, and looking at passengers or the dashboard.

Distraction is dangerous for pedestrians for three main reasons. It slows the driver’s reaction time. It can cause a driver to miss a crosswalk signal or a sign. It also makes it easy to overlook someone stepping off a curb.

Distraction is often shown through evidence after a crash. Phone records, vehicle data, and witness statements can show what the driver was doing in the seconds before impact. These records matter because they help explain what happened and why the driver did not see the person in time.

Pedestrians can’t control a driver’s attention. Making eye contact with drivers before stepping into a lane is still a practical habit.

Failure to Yield at Crosswalks and Intersections

Failure to yield is one of the most common ways a driver and a pedestrian end up in the same place at the same moment. Under Georgia law, a driver must stop and stay stopped for a pedestrian in a crosswalk in certain positions. O.C.G.A. § 40-6-91(a) applies when the pedestrian is on the half of the road the vehicle is using, or is approaching and within one lane of the half the vehicle is traveling on or turning onto.

Common yield failures include turning vehicles that don’t stop for people in the crosswalk, rolling stops, and drivers focused on cross traffic instead of people walking. Each of these leaves the pedestrian with little time to react.

Crossing outside a crosswalk has different rules. O.C.G.A. § 40-6-92(a) says a pedestrian crossing at a point other than a marked or unmarked crosswalk at an intersection must yield to vehicles, unless the pedestrian has already, and under safe conditions, entered the roadway. The same section covers pedestrians crossing a roadway at any point other than within a marked crosswalk or an unmarked crosswalk at an intersection, and requires them to yield the right of way to all vehicles upon the roadway unless they have already, and under safe conditions, entered the roadway.

Right-of-way disputes usually turn on three things: where the pedestrian was, what the signal showed, and the path of the vehicle. For an overview of how these claims work, read our pedestrian accident guide.

Speeding, Impaired Driving, and Poor Visibility

Speeding, impaired driving, and poor visibility all make it harder for a driver to see a person and stop in time. Each one works on a different part of the driver’s ability to respond.

Speeding leaves less time to stop. It also increases the force of impact when a pedestrian is struck. The Governors Highway Safety Association reports that pedestrians and other people outside vehicles are especially vulnerable in collisions, and that these crashes can cause serious injuries, including head injuries.

Impaired driving affects reaction time, judgment, and attention. Alcohol or drugs can cause a driver to misjudge distance and fail to notice a person on the road.

Poor visibility includes nighttime driving, rain, glare, and dark clothing worn by the pedestrian. A driver’s headlights and attention decide whether a person is seen in time. Georgia law requires every driver to exercise due care to avoid colliding with any pedestrian, with extra precautions for children and for people who appear confused, incapacitated, or intoxicated, under O.C.G.A. § 40-6-93.

These factors often show up alongside distraction and failure to yield in the same crash.

Roadway and Infrastructure Conditions

Roadway design and conditions can add risk, and they are a separate factor from driver behavior. The Georgia DOT pedestrian safety assessment links higher speeds, undivided or multilane roads, arterial roads, transit stops, schools, and non-daylight conditions to higher pedestrian crash risk.

Conditions that can contribute include faded or missing crosswalk markings, poor lighting, long distances between safe crossings, and wide roads with fast traffic. Sometimes these conditions involve a property owner. In other cases, a city or county may be involved.

Claims against a city in Georgia have their own rules. Under Georgia’s municipal claim notice law, a written claim must generally be presented to the city within six months of the event. Owners of land can also have a duty to keep premises safe for people invited onto them, which is part of the premises liability work the firm handles.

Frequently Asked Questions About Pedestrian Crash Causes
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
What is the most common cause of pedestrian accidents in Georgia?

Driver behavior is the cause most often named.
