Usually, yes, through one case. Georgia generally allows one wrongful death action for a death, filed by one eligible person, and several relatives can share in what is recovered.

This page explains who may bring the claim, how recovery is shared, and why the time between injury and death matters.

The short answer: usually one claim, filed by one person for everyone

Can multiple family members file a wrongful death claim together? In most cases, the family moves forward through one action. Several relatives can be eligible for what the case recovers, even though only one person files it.

Which relatives qualify depends on who survived the decedent. It also depends on the facts of the crash, fall, dog attack, or other incident that caused the injury. The order of who may file is set out in Georgia’s wrongful death statute, so it helps to know that order early. Two families with similar injuries can still face very different questions about who signs first.

Families should also understand that two kinds of claims can arise after a death. One belongs to the family’s own loss. The other belongs to the injured person’s estate. Both are covered below.

If you are still deciding who should file for your family and when, our team can walk through your situation with you in a free, confidential consultation. The statute measures that recovery as the full value of the decedent’s life, as shown by the evidence. If there is no surviving spouse, a child or children may recover instead.

The statute covers a child or children who are either minors or adults. Adult children and minor children both fall within it.

The wrongful death statute names the spouse and the children. O.C.G.A. § 51-4-2 reads: “If an action for wrongful death is brought by a surviving spouse under subsection (a) of this Code section and the surviving spouse dies pending the action, the action shall survive to the child or children of the decedent.” Other relatives are not part of that group. That route applies only in that situation.

How recovery is shared among family members

Money from a wrongful death claim is divided by the statute’s rules, not by who filed first.

Under O.C.G.A. § 51-4-2, if a surviving spouse and children survive, the amount recovered is equally divided among the surviving spouse and the children per capita, but the surviving spouse receives no less than one-third of the recovery. Per capita means each person is counted equally. The spouse always receives at least one-third of the recovery.

If there is no surviving spouse, the recovery is divided equally among the children.

The statute also protects the recovery from certain debts. Under § 51-4-2(e), no recovery under subsection (a) is subject to any debt or liability of the decedent or the decedent’s estate.

Funeral and related costs follow a separate path. Under O.C.G.A. § 51-4-5, when death results from a crime or from criminal or other negligence, the personal representative may recover funeral, medical, and other necessary expenses. The personal representative is the administrator or executor who acts for the estate.

Other relatives still have a stake in how the money is divided, so it helps to ask how decisions will be made and who signs.

Why a survival claim for injuries before death can be separate

A survival claim covers the harm the injured person suffered before death, and it passes to the estate’s personal representative.

Under O.C.G.A. § 9-2-41, an action for injury to the person does not end just because a party dies. If the injured person dies and no one else has a right of survivorship, the cause of action goes to the personal representative of the deceased plaintiff.

In plain terms, the wrongful death claim looks at the family’s loss. The survival claim looks at what the injured person went through before death. Both can come from the same crash, fall, or attack.

Families often mix these two claims together. Keeping them separate from the start makes the case easier to follow. It also makes it clearer who acts for the estate and who acts for the family.

How the time between injury and death can affect the claim

The time between the injury and the death often matters, because records from those days show both the injuries and the cause of death.

A person may live for days or weeks in a hospital, a rehab unit, or at home. Each record from that period becomes evidence. Emergency room notes, surgery reports, intensive care charts, and discharge papers all tell part of the story.

The Georgia Bureau of Investigation Division of Forensic Sciences explains which deaths fall under that act. If a coroner or medical examiner was involved, keep that paperwork too.

Medical bills need careful handling. In a civil action for injury or death, Georgia law caps special damages for medical and healthcare expenses at the reasonable value of medically necessary care, treatment, or services, and the trier of fact decides that amount (Official Code of Georgia). The judge or jury decides that value.

Georgia’s general two-year limit for injury-to-person claims is in O.C.G.A. § 9-3-33. How that limit applies to a particular family’s timing depends on the facts. Start a folder with hospital records, discharge papers, and bills now.

Common questions families ask when more than one relative wants to be involved

Family members often want to ask questions and stay informed, even when they are not the person named in the case.
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Can an adult child who is not the closest relative ask questions?

Yes, family members can ask questions and seek updates.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Who signs, and what if relatives disagree?

Under O.C.G.A. § 51-4-2, a surviving spouse may release the alleged wrongdoer without the children’s agreement or a court order.
