Jaraysi · Published October 21, 2026

Georgia generally gives you two years to file a lawsuit after a slip and fall injury (O.C.G.A. § 9-3-33; Cameron v. JMP Pizza, Inc. (2026)). For most falls on private property in Johns Creek, that two-year rule is the deadline to plan around. The two-year period applies except as otherwise provided in this article, and the section itself sets one year for injuries to reputation and four years for injury claims involving loss of consortium. This page explains how the clock works, what can pause it, and what to do if time is running out.

What is the statute of limitations for filing a slip and fall lawsuit in Johns Creek Georgia?

For most slip and falls on private property, Georgia generally requires a lawsuit within two years after the injury. The general limit comes from O.C.G.A. § 9-3-33, which applies to actions for injuries to the person.

A slip and fall is usually handled as a premises liability claim. That means the property owner or occupier can be responsible when it fails to use ordinary care to keep its premises safe for people invited there. O.C.G.A. § 51-3-1 states that duty. Under § 9-3-33, the two-year limit governs most of these claims, unless a special notice rule for public property applies, while § 51-3-1 sets the duty to exercise ordinary care in keeping the premises and approaches safe.

The date of the fall is the anchor for every other decision in the claim. Mark that date now.

If you're watching a deadline while you recover from a fall, you don't have to work out the dates alone; our team can talk it through with you. Medical treatment, bills, and insurance offers can take time, so talking with a lawyer early can help you understand your options.

Say you slipped on a wet store floor in Johns Creek on March 3. The count starts on March 3. It does not start on the day your last doctor visit ended. Many people wait until treatment is finished before they think about the date, and that is a costly delay.

Start a simple written record today. Note the date, the time, the exact spot, what caused the fall, and the name of the business or property owner. Take photos if you can, and write down the names of any witnesses. These facts anchor the deadline and any later notice.

Are there exceptions to the two-year Georgia statute of limitations for slip and fall claims?

All claims against counties must be presented within 12 months after they accrue or become payable or the same are barred, provided that minors or other persons laboring under disabilities shall be allowed 12 months after the removal of the disability to present their claims (O.C.G.A. § 36-11-1). O.C.G.A. § 9-3-33 provides that injury actions “shall be brought within two years after the right of action accrues.”

These rules are narrow, and they are not a reason to wait. Whether one fits a particular fall depends on the facts. A lawyer can review those facts with you.

Do claims against a city or county in Johns Creek have a shorter deadline?

Yes, when a city owns the property, the first deadline is much shorter. Under O.C.G.A. § 36-33-5, no lawsuit can be brought against a city until a written claim goes to its governing authority. That claim must be presented within six months of the event.

The written claim must state the time, place, and extent of the injury, and the negligence that caused it. It must also state the specific dollar amount of damages sought. It must be served on the mayor, or the chairperson of the city council or commission, by personal delivery, certified mail, or statutory overnight delivery. The city then has 30 days to act. The filing clock is paused while the demand sits with the city without action.

County claims follow a different timeline. Under O.C.G.A. § 36-11-1, claims against counties must be presented within 12 months after they accrue or become payable, or they are barred, but minors or other persons under disabilities get 12 months after the disability is removed. State claims under O.C.G.A. § 50-21-26 need written notice within 12 months of the date the loss was discovered or should have been discovered.

Who owns the property decides which deadline applies. Skipping a notice step can block a lawsuit, even if the two-year date is still ahead.

Does filing an insurance claim stop the statute of limitations, and what happens if the deadline passes?

No. Insurance talks are not a lawsuit, and they don’t replace the filing or notice steps described above. An insurer may take weeks or months to respond. Don’t let a pending claim become the reason you miss a date.

If the deadline passes without a lawsuit or a required notice, you can lose the right to pursue the claim in court. That is why the date matters so much.

Georgia also reduces damages based on fault. Under O.C.G.A. § 51-12-33, damages are cut in proportion to the injured person’s share of fault. A person who is 50 percent or more responsible cannot recover damages.

What should someone in Johns Creek do next if a slip and fall deadline is approaching?

If a deadline is close, the next step is to have the date, the property owner, and any notice rule reviewed now. You may be reading this for a family member. You may also be recovering from a fall and handling bills and insurer calls yourself.
