A surviving spouse comes first. If there is no surviving spouse, the children come next.

Losing someone suddenly is hard, and money questions arrive fast. You may be planning a funeral, gathering papers, or trying to understand what the law allows. Many families ask, “Who gets paid in a wrongful death lawsuit?” before anything else.

Georgia’s rule comes from O.C.G.A. § 51-4-2, the state’s wrongful death statute for a spouse or parent. If there is no surviving spouse, a child or children may bring it. The law names these people, so the right to sue does not pass to every relative.

Being a close relative is not the same as having the legal right to file. A parent, sibling, or friend may grieve deeply and still have no right to bring the claim. Families often assume the closest or oldest person files. The statute’s order decides it.

When no one in those groups can sue, the estate steps in. Under O.C.G.A. § 51-4-5, when there is no person entitled to bring an action under Code Section 51-4-2 or 51-4-4, the administrator or executor of the decedent may bring the action. That person holds the recovery for the benefit of the next of kin.

A child’s death has its own rule under O.C.G.A. § 51-4-4, which points to other Georgia code sections. The child’s situation can differ, so ask about it directly.

How the Money Is Divided Among Family Members

When a spouse and children survive, the recovery is shared equally, per capita, meaning equal shares per person, except that the surviving spouse shall receive no less than one-third of the recovery as the spouse’s share. The surviving spouse always receives at least one-third of the recovery. That floor is the detail families most often need to know.

If there is no surviving spouse, the children share the recovery equally. If one child has died, that child’s descendants take that child’s share per stirpes, meaning by family branch.

Families often miss this point during the early weeks of an estate.

Under Georgia law, the surviving spouse brings the wrongful death claim under O.C.G.A. § 51-4-2 (Keais v. Kelley (2026)), and a child or children bring it only if there is no surviving spouse. When a minor child shares in a settlement and there is no surviving spouse, the natural guardian, guardian, or next friend must obtain court approval of the settlement as provided in Code Section 29-3-3, under O.C.G.A. § 51-4-2(b)(3)(B). How shares fall depends on who survived and the facts of the family.

What a Wrongful Death Claim Can Include

A claim for the homicide of a spouse or parent can seek the full value of the decedent’s life, as the evidence shows. For the homicide of a spouse or parent, the surviving spouse or, if there is no surviving spouse, a child or children may bring it.

Necessary expenses are a separate item. Under O.C.G.A. § 51-12-7, necessary expenses from an injury are a legitimate part of the damages estimate. When death results from a crime or from criminal or other negligence, the personal representative may recover funeral, medical, and other necessary expenses, under O.C.G.A. § 51-4-5.

Proof matters. Georgia law presumes some damages and requires proof of others. Special damages, which actually flow from the wrong, must be proved, under O.C.G.A. § 51-12-2. Keep funeral receipts, medical bills, and records from the start.

Every claim is different. The evidence decides which categories apply and how they are supported.

How Wrongful Death Settlements Are Paid

A settlement is paid after the parties sign the agreement and any required court approval is complete. The timing depends on those steps, so families should plan for a process rather than a single date.

Some settlements pay part of the money over time. The settlement agreement sets out those terms in writing, so read every payment term before you sign. Estate steps and court orders can also affect timing.

Medical bills can complicate payment. When Medicare has paid those costs, its Secondary Payer Recovery Portal handles conditional-payment recovery. Ask how Medicare issues will be resolved before you agree to terms.

Are Wrongful Death Payments Taxable, and What Costs Come Out?

Tax questions depend on how a settlement is structured and what it pays for. Ask about your family’s facts before you sign any agreement, and keep the answers in writing.

Case costs are a separate question from attorney fees. Ask how case costs and expenses are handled, and how any fee is calculated, before you agree to anything. Get those answers in writing so the family knows what to expect.

Some families also want to know what a court filing involves. Georgia Courts explains how electronic case filing works and which courts use it in its e-file court records information.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

How Long a Family Has to File and How to Talk With Our Team

Georgia’s general deadline for actions for injuries to the person is two years after the right of action accrues, under O.C.G.A. § 9-3-33.
