Jaraysi · Published October 19, 2026

Yes. Georgia is an at-fault state for car accidents. The driver who caused the crash is generally responsible for the damages that follow. If you’re asking this after a crash, you probably want to know who pays and what happens next. This guide explains how fault works in Georgia, in plain terms.

The short answer: Georgia is an at-fault state

Georgia is an at-fault state, so the person who caused the crash is generally the one responsible for the harm. An at-fault system asks one basic question: whose careless driving led to the collision?

A no-fault system works differently. In a no-fault state, each driver’s own insurance usually pays their own injuries first, no matter who caused the crash. Georgia is not a no-fault state for car accidents.

That difference matters. In Georgia, an injured person usually looks to the at-fault driver’s liability insurance for compensation. The at-fault rule shapes who an injured person can pursue and why the other driver’s insurer often becomes central to a claim.

Many people search this question after a crash they did not cause. They want a clear answer before they decide what to do next.

If someone else's driving left you or a family member hurt, our team can go over the facts with you in a free, confidential first consultation. Common examples include speeding, running a red light, following too closely, and looking at a phone instead of the road.

Proving fault is the central job in most claims.

Liability coverage from the at-fault driver’s policy is often the main source of payment. Injured people sometimes assume their own policy will pay first. Don’t assume that. Whether your own coverage applies depends on your policy and the facts of the crash.

Crashes can also involve more than one careless driver. Each driver’s share of fault can matter, which the next sections explain.

How fault is determined after a Georgia crash

Fault is decided from the evidence. That evidence can include the police report, witness statements, photos of the scene, vehicle damage patterns, traffic camera footage, and phone or vehicle data when it is available.

Insurance adjusters and courts both weigh this evidence. Their conclusions can differ from what people believed at the roadside. A quick first impression is not the final word.

Georgia law also looks at everyone who contributed to the harm. Under O.C.G.A. § 51-12-33, the decision-maker must consider the fault of all persons or entities who contributed, whether or not they were named in the suit.

Damages are then divided among the liable people by their percentage of fault. That liability is not joint, so each person pays only their assigned share.

Write down what you remember while it is fresh. Note the time, the weather, the lanes, and where each car stopped.

Georgia’s modified comparative negligence rule

Georgia lets an injured person who shares some blame still seek recovery. This is often called modified comparative negligence (shared fault). Under O.C.G.A. § 51-12-33, when an injured person is to some degree responsible for the injury or damages claimed, the judge reduces the damages otherwise awarded in proportion to that person’s percentage of fault, and the plaintiff is not entitled to receive any damages if the plaintiff is 50 percent or more responsible.

Under that statute, the judge reduces the damages in proportion to the injured person’s percentage of fault (O.C.G.A. § 51-12-33; Quynn v. Hulsey, 310 Ga. 473 (2020)). A small share of fault leads to a small reduction. A larger share leads to a larger one.

Here is a simple, hypothetical example. Suppose the total damages in a case are the full amount of the losses, and the injured driver is found 20 percent at fault. The award would be reduced by 20 percent. This is only an illustration, not a prediction of any result.

The rule has a hard line at 50 percent. A plaintiff who is 50 percent or more responsible for the injury or damages claimed is not entitled to receive any damages (O.C.G.A. § 51-12-33; Quynn v. Hulsey, 310 Ga. 473 (2020)).

Because a few percentage points can change the outcome, fault arguments get serious. Insurers often argue about the exact split.

Insurance limits and why they matter

Georgia requires uninsured motorist coverage to be offered in auto policies. Under O.C.G.A. § 33-7-11, an automobile liability policy issued in Georgia must contain provisions that pay an insured person for bodily injury caused by an uninsured motor vehicle’s owner or operator, unless the insured rejects that coverage in writing. O.C.G.A. § 33-7-11 reads: “(a)(1) No automobile liability policy or motor vehicle liability policy shall be issued or delivered in this state to the owner of such vehicle or shall be issued or delivered by any insurer licensed in this state upon any motor vehicle then principally garaged or principally used in this state unless it contains an endorsement or provisions undertaking to pay the insured damages for bodily injury, loss of consortium or death of an insured, or for injury to or destruction of property of an insured under the named insured’s policy sustained from the owner or operator of an uninsured motor vehicle, within limits exclusive of interests and costs which at the option of the insured shall be.” The coverage applies within limits the insured chooses. O.C.G.A. § 33-7-11 reads: “(a)(1) No automobile liability policy or motor vehicle liability policy shall be issued or delivered in this state to the owner of such vehicle or shall be issued or delivered by any insurer licensed in this state upon any motor vehicle then principally garaged or principally used in this state unless it contains an endorsement or provisions undertaking to pay the insured damages for bodily injury, loss of consortium or death of an insured, or for injury to or destruction of property of an insured under the named insured’s policy sustained from the owner or operator of an uninsured motor vehicle, within limits exclusive of interests and costs which at the option of the insured shall be.”

This matters because the at-fault driver’s policy has limits too. A serious injury can cost more than a policy pays. O.C.G.A. § 33-7-11 reads: “(a)(1) No automobile liability policy or motor vehicle liability policy shall be issued or delivered in this state to the owner of such vehicle or shall be issued or delivered by any insurer licensed in this state upon any motor vehicle then principally garaged or principally used in this state unless it contains an endorsement or provisions undertaking to pay the insured damages for bodily injury, loss of consortium or death of an insured, or for injury to or destruction of property of an insured under the named insured’s policy sustained from the owner or operator of an uninsured motor vehicle, within limits exclusive of interests and costs which at the option of the insured shall be.” (Full text of the statute)

If the at-fault driver has little or no coverage, your own uninsured motorist coverage may be relevant. Ask the insurer what your policy says about that coverage.

Georgia law also limits medical expense damages. They are limited to the reasonable value of medically necessary care, treatment, or services, under O.C.G.A. § 51-12-1.1. Keep bills and records that show what care was needed.

What to avoid saying and doing after a crash

Be careful with recorded statements. This includes statements to the other driver’s insurance company. Stick to facts you know. Don’t guess about who was at fault or how badly you are hurt.

Describe symptoms as they feel today. Injuries sometimes appear or worsen days later. Saying “I’m fine” early can be used later to question your injuries, even when you were simply in shock.

Keep records. Save photos, the police report number, medical visit notes, bills, prescriptions, and receipts for out-of-pocket costs. Keep a short log of missed work and rides to appointments.

Early statements and records can be used later to evaluate fault and damages. Before you answer a question from an insurer, ask yourself what the answer could mean.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Reporting the crash and the time limit to bring a claim

The Georgia Department of Driver Services explains those duties in its crashes section. Reading that page is a good starting point for the reporting rules.

Time limits also matter. Loss of consortium claims have a longer period under the same statute.

Some exceptions exist.
