Settlement is common, but it is not automatic, and each case moves at its own pace.

If you are reading this after a death, you may be grieving and handling paperwork at the same time. In Georgia, the claim belongs to specific people the law names. A surviving spouse may bring a claim for the death of a spouse or parent. If there is no surviving spouse, a child or children may do so. The law measures the claim as the “full value of the life of the decedent, as shown by the evidence” (O.C.G.A. § 51-4-2). That value is figured without subtracting the person’s own necessary or personal expenses had he lived (O.C.G.A. § 51-4-1).

When no one else can sue under those sections, including a parent of the deceased, the administrator or executor of the estate may bring the action for the next of kin (O.C.G.A. § 51-4-5). If the death results from a crime or from criminal or other negligence, the personal representative may also recover funeral, medical, and other necessary expenses.

Settlement papers usually include a release. A release is a document in which the person who receives money agrees to end the claim against the party who pays. Who signs can depend on who the beneficiaries are. A surviving spouse may release the other side without the children’s agreement, but must hold the money under the statute’s rules. If there is no surviving spouse and a minor child is a beneficiary, the guardian or next friend must get court approval of the settlement, as provided in O.C.G.A. § 29-3-3.

Why so many wrongful death claims resolve before trial

Most claims settle because a trial is slow, expensive, and hard on a family. The outcome of a jury trial is uncertain for both sides. Insurers and defendants weigh that risk against the cost of continuing. That math often pushes both sides toward an agreement.

Fault is a big part of that math. Georgia reduces damages in proportion to a person’s own share of fault. It bars recovery when that share is 50 percent or more (O.C.G.A. § 51-12-33; Quynn v. Hulsey, 310 Ga. 473 (2020)). Because each side knows this rule could change the outcome, each side has reason to test its position early.

Negotiation tends to get serious once the record is strong enough for each side to judge the claim. That record often includes the incident report, medical or facility records, and proof of the family’s losses. Clear facts give both sides something concrete to evaluate. Still, settlement is not automatic. Some cases do not settle, and families should understand that possibility from the start.

How a wrongful death claim usually moves toward settlement

The usual order is facts first, then a demand, then negotiation. The family gathers records and identifies who may be responsible. That could be a driver, a property owner, a security provider, or a care facility. A demand letter then goes to the insurer, and negotiation follows. Mediation is a common next step. In mediation, a neutral person helps both sides work toward an agreement. It can happen before or after a lawsuit is filed.

Timing matters. Georgia’s general deadline for actions for injuries to the person is two years after the right of action accrues (O.C.G.A. § 9-3-33; Cameron v. JMP Pizza, Inc. (2026)). When a crime is involved, that clock may pause while a criminal case is pending. The pause cannot exceed six years (O.C.G.A. § 9-3-99). How these rules apply to a particular death depends on the facts, so it helps to ask early.

Some incidents involve different evidence and different parties. If your situation involves a motorcycle or pedestrian crash, read our guides on wrongful death motorcycle claims and wrongful death pedestrian claims.

What happens when a case does not settle

If the two sides cannot agree, the claim can move into litigation. A lawsuit opens a stage called discovery, where each side exchanges information. Motions may follow, and the case may go to trial before a judge or jury. A trial has its own schedule and its own uncertainty. It often takes longer than a negotiated settlement.

Neither path is automatically the better one. The choice between continuing to negotiate and moving toward trial involves the family’s input. Families weigh the timing, the cost, and the emotional toll of each option. Decisions are easier when everyone has clear information about dates and documents.

Why an average settlement figure does not answer the question

Average figures combine very different cases, so they rarely describe one family’s situation. A death in a highway crash, a death from a fall on an unsafe property, and a death in a care facility involve different causes, parties, insurance, and evidence. Averaging them hides those differences. An average is not a prediction for your family.

The questions that shape a claim are more useful. How did the death happen? Who may be responsible? What evidence exists? Who are the statutory beneficiaries? These answers shape how fault and damages are evaluated.

When more than one party shares fault, Georgia does not make each one pay the whole amount. The trier of fact, meaning the judge or jury deciding fault, divides the award by each person’s percentage of fault. Each share is that person’s own, not a joint liability. The fault of nonparties can also be considered (O.C.G.A. § 51-12-33; Quynn v. Add any police or incident report, medical or facility records, and letters or calls from insurance adjusters. Adjusters may contact family members quickly. It is reasonable to ask what is being requested before giving a recorded statement or signing anything. Keep a dated written log of calls, names, and documents.

Two more points often come up. If the person who died had Medicare, expect that issue to come up in any settlement. The Medicare Secondary Payer rules can affect how settlement funds are handled.

Quick answers

Do most wrongful death cases in Georgia settle? Most are resolved through negotiation, and many settle before trial. Each case still follows its own path.

Who can file a wrongful death claim in Georgia? A surviving spouse may bring the claim. If there is no surviving spouse, a child or children may bring it. If the person who died was a child and no spouse or child survives, a parent may bring it. An administrator or executor can act for the next of kin when no one else is entitled.

Does a court have to approve a settlement? Yes, when there is no surviving spouse and a minor child is a beneficiary.

Can a criminal case affect the deadline? It can pause the time limit while the criminal case is pending, for no more than six years.

Talk through your situation with our team

If you are trying to understand a claim while also grieving someone you loved, you do not have to sort it out alone.
