The city is not treated like a private property owner, though. Georgia law adds steps that must happen first, and several carry strict deadlines.

Common examples include a pothole or road defect that leads to a car or motorcycle crash, a broken city sidewalk that causes a pedestrian to fall, and an unsafe condition on city-owned property that causes a slip and fall. Each case has its own facts.

This guide explains how to sue the City of Atlanta step by step. It covers the notice rule, the lawsuit deadline, and what happens after a claim is filed. The first steps often matter as much as the lawsuit itself.

If a pothole, a broken city sidewalk or unsafe city property left you or someone you love hurt, our team can talk through what you're facing and the deadlines involved. That rule is written for landowners in general, so a city’s situation needs its own review.

The type of city action or inaction also matters. Because these rules are technical, a city claim often needs more groundwork than a claim against a private business.

The Six-Month Notice Requirement (Ante Litem Notice)

Under Georgia law, a claim for money damages against a city generally must be presented in writing within six months after the event. This written step is called ante litem notice, which means notice given before a lawsuit. Under O.C.G.A. § 36-33-5, a person with a claim for money damages against a municipal corporation for injuries to person or property must give notice by presenting the claim in writing to the municipal corporation’s governing authority within six months of the event, stating the time, place, and extent of the injury, as nearly as practicable, and the negligence that caused it, and no action may be brought against the municipal corporation for such injuries until the claim has first been presented for adjustment.

The notice must state the time, place and extent of the injury, as nearly as practicable. It must also describe the negligence that caused the injury. The description of the injury must include the specific amount of money damages you are seeking from the city.

That amount matters more than many people expect. The stated figure is an offer of compromise. If the city does not settle and the claim goes to litigation, the amount in the notice is not binding on you.

The notice goes to the city’s governing authority. It must be served on the mayor, or on the chair of the city council or commission. Delivery can be personal, by certified mail, or by statutory overnight delivery.

Without this notice, the courts will not hear the case against the city. A missed six-month window can bar a claim even when the city’s negligence looks clear.

Filing Deadlines for a Lawsuit Against the City

Georgia’s general deadline for injuries to a person is two years after the right of action begins (O.C.G.A. § 9-3-33; Cameron v. JMP Pizza, Inc. (2026)). Claims involving loss of consortium have a four-year deadline under the same section.

The six-month notice and the two-year lawsuit deadline are separate. The same city statute also pauses the limitations period while a demand is pending before city officials without action. That pause applies only in those conditions, so it is not a plan to wait.

The city must consider and act on the claim within 30 days of presentation. Its action, unless it settles the claim, does not bar a lawsuit in court.

O.C.G.A. § 51-4-2 lets a surviving spouse, or if there is none, the child or children, recover for the homicide of the spouse or parent. If there is no surviving spouse, a child or children may recover. The recovery is the full value of the decedent’s life, as shown by the evidence. Families facing a death should review timing early, because the deadlines are strict.

Steps from the Incident to a Filed Lawsuit

Taking the steps in order helps protect your claim.

Preserve evidence first. Take photos of the condition and the location. Write down witness names and get any incident report. Keep medical records that link the injury to the event.

Send the written notice within six months. Keep a copy and proof of how it was delivered.

Wait for the city’s response. The city must act within 30 days.

File the lawsuit if the claim does not settle. File within the deadline and serve the city the way the law requires.

Georgia also reduces damages based on fault. Under O.C.G.A. § 51-12-33, the judge reduces an award in proportion to the injured person’s percentage of fault. A person found 50 percent or more responsible for the injury recovers nothing. The fault of others who contributed is also considered.

After filing, both sides exchange evidence in a stage called discovery. The case may end in a settlement or go to trial. No outcome can be predicted in advance.

Can You Sue for Emotional Distress?

How it is handled depends on how the injury happened and what the evidence shows.

The noneconomic damages overview explains that these can include emotional distress and physical pain and suffering. Medical bills and lost wages are different. They are economic losses with a clearer paper trail.

Keep records of both kinds of loss. Doctor visits, bills, pay records and a personal journal can all help show what changed after the incident. No one can say in advance what emotional distress is worth.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Class Actions and Group Claims Against the City

A class action is a lawsuit filed on behalf of a larger group of people with similar claims. It follows its own procedural rules, which differ from an individual injury claim.

Most injury claims against a city, such as a single crash or a single fall, proceed as individual claims. Whether a group claim fits a situation depends on the facts. The key question is whether others share the same injuries from the same city condition.

Talk With Our Team About Your Situation

Maybe you’re reading this because your mother’s car hit a pothole on a city road.
